RESOLUTION OF COUNCIL OF MINISTERS OF THE REPUBLIC OF BELARUS

About approval of Rules of protection of precious metals and gemstones in case of their transportation on the territory of the Republic of Belarus

According to the paragraph the tenth article 6 of the Law of the Republic of Belarus of November 8, 2006 "About security activities in the Republic of Belarus" the Council of Ministers of the Republic of Belarus DECIDES:

1. Approve the enclosed Rules of protection of precious metals and gemstones in case of their transportation on the territory of the Republic of Belarus.

2. This resolution becomes effective in three months after its official publication.

Rules of protection of precious metals and gemstones in case of their transportation on the territory of the Republic of Belarus

Chapter 1 General provisions

1. The these rules developed according to the paragraph the tenth article 6 of the Law of the Republic of Belarus of November 8, 2006 "About security activities in the Republic of Belarus" (The national register of legal acts of the Republic of Belarus, 2006, No. 187, 2/1272), is regulated preservation scheme of precious metals and gemstones in case of their transportation on the territory of the Republic of Belarus.

2. Action of these rules extends to the organizations performing protection of precious metals and gemstones in case of their transportation on the territory of the Republic of Belarus by road, water, railway or air transport (further, unless otherwise specified, - protection of precious metals and gemstones).

Action of these rules does not extend on:

the collection and (or) transportation of precious metals and gemstones performed by banks and the non-bank credit and financial organizations according to the legislation;

transportation of foreign diplomatic mail (consular bag) and diplomatic mail (consular bag) of the Republic of Belarus with investment of precious metals and gemstones;

transportation of materials, and also the scrap and waste containing less than 5 percent of precious metals in cost equivalent of gold;

transportation of products from precious metals and gemstones worth up to 3 thousand euros;

transportation of products from the precious metals having test below the minimum values of the tests established by the legislation for branding of jewelry and other products from precious metals;

transportation of the gemstones carried according to the procedure, established by the legislation, to not suitable for production of jewelry;

the protection of particular loads performed by internal troops of the Ministry of Internal Affairs;

the protection of precious metals and gemstones performed by the state military forming and paramilitary organizations which are not specified in these rules.

3. In these rules terms and their determinations in the values established by the Law of the Republic of Belarus of June 21, 2002 "About precious metals and gemstones" are used (The national register of legal acts of the Republic of Belarus, 2002, No. 73, 2/859), and also the Law of the Republic of Belarus "About security activities in the Republic of Belarus".

4. Protection of precious metals and gemstones is performed according to the legislation:

Department of protection of the Ministry of Internal Affairs (further - Department of protection);

The public courier service of the Republic of Belarus under the Ministry of Communications and Informatization;

republican unitary enterprise "Special Communication";

the legal entities performing activities with the precious metals and gemstones belonging to them.

Protection of precious metals and gemstones cannot be performed by individual entrepreneurs and their workers, and also the physical persons who are not workers of the legal entities specified in part one of this Item.

5. Protection of precious metals and gemstones worth over 30 thousand euros is performed by the armed staff (workers) of the organizations specified in paragraphs the second - the fourth part one of item 4 of these rules.

Protection of the precious metals and gemstones which are not specified in part one of this Item can be performed by the legal entities called in paragraph five of item 4 of these rules.

Chapter 2 General requirements to implementation of protection of precious metals and gemstones

6. Transportation of precious metals and gemstones is performed by vehicles of the organizations specified in part one of item 4 of these rules.

7. For implementation of protection of precious metals and gemstones maintenance vehicles can be allocated.

8. When transporting precious metals and gemstones by road transport during movement and the parking of door of the vehicle shall be blocked, windows are closed.

9. It is forbidden to the staff (workers) of the organizations specified in part one of item 4 of these rules:

allow in the vehicle or transport in it strangers;

transport foreign loads, including fuels and lubricants in inside (cargo section) of the vehicle;

open metal boxes, safes, suitcases, portfolios and other packaging means in which precious metals and gemstones are transported (further - packaging means), to break integrity of packaging means, and also the seals which are available on them, one-time sealing materials;

leave precious metals and gemstones without protection;

disclose to strangers or transfer with use of means of radio communication (in the presence of permission to use of radio-frequency resource) the data containing information on precious metals and gemstones, including on their name, quantity, the cost, time and route of transportation, forces and means involved for their protection;

perform other actions which are not connected with fulfillment of duties.

Chapter 3 Procedure of protection of precious metals and gemstones by department of protection

10. The basis for implementation of protection of precious metals and gemstones by Department of protection is the agreement on rendering (accomplishment) security services signed with the customer - legal or physical person, including the individual entrepreneur (further - the customer), according to the request about protection of precious metals and gemstones (further - the request).

11. The number of office vehicles, and also the employees performing protection of precious metals and gemstones is determined by the chief (commander) of division of Department of protection proceeding from assessment of operational situation and possibility of ensuring reliable protection of precious metals and gemstones.
