Quality requirements and to placement in the market of material for reproduction of ornamental plants creates necessary basis for application of the Directive No. 98/56/EC of Council of July 20, 1998 about the trade in material for reproduction of ornamental plants published in the Official magazine of the European Community, No. 226/16 series L of August 13, 1998, Directives No. 93/49/EEC of the Commission of June 23, 1993 about establishment of the cards specifying conditions to which there shall correspond material for reproduction of ornamental plants according to the Directive 91/682/EEC of Council published in the Official magazine of the European Community, No. 250/9 series L of October 7, 1993, and also Directives of the Commission No. 1999/66/EU of June 28, 1999 establishing requirements to labeling or to other documents published by the supplier according to the Directive of Council No. 98/56/EU published in the Official magazine of the European Community No. 164/76 series L of July 30, 1999.

Chapter I. General requirements

1. Quality requirements and to placement in the market of material for reproduction of ornamental plants (in further – Requirements) establish the minimum requirements to quality and placement in the market of material for reproduction of ornamental plants (in further – material for reproduction) which are applicable both to domestic, and to the imported products.

2. These Requirements do not extend to material for reproduction which products are not intended for the decorative purposes if they fall under action of other regulations for realization of these materials.

Chapter II. Terminology

3. In these Requirements the determinations provided in the Law No. 228 of September 23, 2010 on protection of plants and phytosanitary quarantine and also the following determinations are used:

1) material for reproduction – seeds, parts of plants or any vegetative material intended for reproduction and landing of ornamental plants or production of ornamental plants;

2) reproduction – reproduction by vegetative method or some other way;

3) the supplier – any physical person or legal entity which makes sells or imports material for reproduction;

4) placement in the market – the sale or delivery by the supplier to other person including availability at the order or in inventory, exposure to sale, the offer for sale of material for reproduction;

5) ornamental plants – group of the plants which are grown up in the decorative purposes.

4. Action of these Requirements extend to the groups of goods brought in the following table according to the Combined commodity nomenclature:

Chapter III. Requirements to material for reproduction in case of its placement in the market

5. Suppliers cannot place in the market material for reproduction, except cases when it corresponds to the conditions provided in these Requirements.

6. Provisions of Item 5 of these Requirements do not extend to the material for reproduction intended for:

1) experimental or scientific purposes;

2) selection works; or

3) preserving genetic variety.

7. The material for reproduction intended for placement in the market shall conform to the following requirements:

1) to be at least, after visual survey, free from any harmful organisms provided in appendix to these Requirements which can influence quality, and from any signs or symptoms of such organisms which can reduce their useful value;

2) to be free from any defects which can affect its quality;

3) to be strong and the satisfactory sizes taking into account its useful value as material for reproduction;

4) in case of seeds to have viability at least 50% of the viability peculiar to each type of plants;
