About adoption of the technical regulation of the Customs union "About requirements to lubricants, oils and special liquids"
According to article 3 of the Agreement on the Eurasian economic commission of November 18, 2011 Council of the Eurasian economic commission solved:
1. Accept the technical regulation of the Customs union "About requirements to lubricants, oils and special liquids" (TR CU 030/2012) (is applied).
2. Determine that the technical regulation of the Customs union "About requirements to lubricants, oils and special liquids" (TR CU 030/2012) becomes effective since March 1, 2014.
3. This Decision shall enter into force upon the expiry of 30 calendar days from the date of its official publication.

About requirements to lubricants, oils and special liquids
Preface
This technical regulation of the Customs union (further - the technical regulation) is developed according to the Agreement on the single principles and rules of technical regulation in the Republic of Belarus, the Republic of Kazakhstan and the Russian Federation of November 18, 2010.
This technical regulation is developed for the purpose of establishment on single customs area of the Customs union single obligatory for application and execution of requirements to lubricants, oils and special liquids, to the fulfilled lubricants, oils and special liquids and to the products received as a result of conversion (utilization) of the fulfilled products at the stages of product lifecycle released on single customs area of the Customs union.
If concerning lubricants, oils and special liquids, the products received as a result of conversion (utilization) of the fulfilled products other technical regulations of the Customs union, then the lubricants, oils and special liquids, products received as a result of conversion (utilization) of the fulfilled products are accepted shall conform to requirements of technical regulations of the Customs union which action extends to them.
1.1. This technical regulation establishes requirements to lubricants, oils and special liquids (further - products), to the fulfilled lubricants, oils and special liquids (further - the fulfilled products), to the products received as a result of conversion of the fulfilled products, for the purpose of protection of life and health of the person, property, the environment, life and (or) health of animals and plants, the prevention of the actions misleading consumers (users) and also for the purpose of resource-saving.
This technical regulation extends on:
a) lubricants, including:
- lubricating oils of organic origin, including:
1) engine oils (universal, carburetor, diesel, for aviation piston engines);
2) gearbox oils;
3) oils hydraulic;
4) oils industrial;
5) oils compressor;
6) oils turbine;
7) rust proof oils;
8) oils electric insulation;
9) oils basic.
- plastic lubricants;
b) special liquids:
- cooling liquids (including lubricant cooling liquids);
- brake fluids;
c) the fulfilled products.
1.2. The major dangerous factors (risks) arising in case of release into the stream of commerce, the address, use (operation) and conversion (utilization) of products are:
fire-and-explosion hazard of products;
content of water and mechanical impurity, in the quantity exceeding the established regulations;
ecological impact of the fulfilled products in case of its hit to the environment;
harmful effects on human body.
1.3. This technical regulation extends to products released, being in circulation on single customs area of the Customs union and the fulfilled products.
1.4. This technical regulation does not extend to the following products:
delivered according to the state defense order;
exported out of limits of single customs area of the Customs union;
being stored in the organizations ensuring safety of the state material reserve;
vegetable oil and animal origin;
received as a result of high-temperature distillation of coal tar (including creosote);
not falling under the concepts "oil", "lubricant", "special liquid", the stipulated in Clause 2 presents of the technical regulation;
the oils applied to production of perfumery and cosmetic products, products of medical appointment and medicines.
In this technical regulation the following terms and their determinations are applied:
safety of products - lack of the unacceptable risk connected with damnification of life, to health of the person, the environment, including plant and animal life taking into account combination of probability of realization of dangerous factor and severity of its effects;
release into the stream of commerce - primary transition of products from the manufacturer (importer) to the seller and (or) the consumer;
identification of products - establishment of the identity of product characteristics provided for obligatory confirmation of conformity, to the characteristics specified in accompanying documents to products;
identification of the fulfilled products - determination of belonging of the fulfilled products to waste of this or that type and establishment of data on its dangerous, resource, technical and other characteristics;
the manufacturer - the legal entity, including foreign, or the individual entrepreneur, the production and sales of products responsible for its compliance to requirements of this technical regulation performing on its own behalf and (or) according to the order;
the importer - the resident of state member of the Customs union who signs with the nonresident of the state of the Customs union the agreement in foreign trade on transfer of products (the fulfilled products) enables storage and the realization (wholesale and (or) retail trade) of these products (the fulfilled products) and bears responsibility for its compliance to requirements of this technical regulation;
lifecycle - stages (stages) of condition of products in case of release into the stream of commerce, the address, use (operation) and conversion (utilization);
products brand - verbal and (or) alphabetic, digital reference of products;
oil - the liquid of oil or synthetic (semi-synthetic) origin used as lubricant and (or) special liquid;
