About delivery locations of goods vehicles

According to Article 200 of the Customs code of Ukraine of March 13, 2012 No. 4495-VI, the subitem 64 of item 4 of the Regulations on the Ministry of Finance of Ukraine approved by the Presidential decree of Ukraine of April 08, 2011 No. 446, and for the purpose of enhancement of forms of control of delivery in customs of purpose of goods which moves customs area of Ukraine automobile water, railway or aviation modes of transport I ORDER:

1. Determine that:

1.1. The territory determined by customs of appointment (or its part) the check point (control Item) through frontier of Ukraine, sea or river port, airport, railway station, free customs zone, division of customs of appointment in which the customs clearance, the companies with continuous cycle of production, cargo customs complex, the territory which adjoins to the central marshaling yard, regional marshaling yard, places of the international post exchange, warehouse of temporary storage or customs warehouse is directly carried out can be delivery location.

1.2. Maintaining the List of delivery locations (further - the List) and entering of changes into it into the single automated information system of customs authorities of Ukraine (further - EAIS of State Customs Service) are performed by the State Customs Service of Ukraine on representation of customs of appointment in form according to appendix to this order.

1.3. According to the decision of the head (authorized by it persons) of customs of appointment to other place, than it is specified in the List, goods can be delivered by road transport:

which can be referred to category of dangerous goods according to the legislation of Ukraine;

which require special storage conditions owing to what they cannot be stored in vehicles for a long time;

currency values which are imported by banks;

which are imported into the address of the companies with continuous cycle of production and held for use in production process;

which on the dimensions or features of transportation cannot be imported into delivery location.

1.4. Prior to movement of the goods specified in subitem 1.3 of Item 1 of this order, the receiver of goods or person authorized by it submits to customs of appointment the written application for consideration and approval of delivery of such goods as road transport to other place, than is specified in the List.

The statement shall contain:

information on goods sufficient for their identification and reference to the goods specified in subitem 1.3 of Item 1 of this order;

the name and the location of object for which territory delivery of these goods is planned.

The decision on provision of such permission is made by the head (authorized by it person) of customs of appointment by putting down of the relevant resolution on the statement.

As confirmation of acceptance by the head (authorized by it person) of customs of purpose of the decision on provision of permission to the goods delivery in the delivery location determined by the receiver of goods or person authorized by it in division of customs clearance of customs of appointment of goods as the receiver or person authorized by it moves the registered original of the statement with the relevant resolution.

1.5. In the territory of delivery location the customs control zone according to the procedure, stipulated by the legislation Ukraine is created.

1.6. The customs of appointment can organize in case of requirement watch of officials of customs round the clock in delivery location.

1.7. In case of determination of purpose of delivery location by customs it is necessary to consider that the territory of delivery location of goods for road transport shall be provided:

lighting and barrier on delivery location territory perimeter;

round-the-clock protection and availability of fire extinguishing means;

availability of stage, platform, observation deck;

availability in enough, and also functioning of cargo handling machinery and mechanisms for implementation of necessary transactions in the territory of delivery location;

availability of channels and means of communication, including with EAIS of State Customs Service of Ukraine, for accomplishment by officials of customs authorities of the powers.

In case of determination the territory delivery location (its part) of cargo customs complex, the territory adjacent to warehouse of temporary storage or customs warehouse, to arrangement of delivery locations apply the requirements established by the legislation of Ukraine to functioning of the specified objects.

1.8. Requirements to delivery locations for air, water and rail transport are established similar to the requirements established by the legislation of Ukraine to customs control zones.

1.9. In case of delivery location exception of the List the customs authority in which zone of activities the delivery location functioned takes sufficient measures concerning the direction of goods and vehicles which crossed customs border of Ukraine, in other functioning delivery location from the List for carrying out necessary customs formalities with the immediate message about specified to interested persons.

2. (Chmeruk M. O.) and to Department of the organization of customs control and registration of the State Customs Service of Ukraine (Syomk S. M.) in accordance with the established procedure to provide to department of tax, customs policy and methodology of financial accounting of the Ministry of Finance of Ukraine:

submission of this order on state registration in the Ministry of Justice of Ukraine;

promulgation of this order.

3. To the State Customs Service (Kaletnik I. G.) within 40 days from the date of official publication of this order to finish the software taking into account requirements of this order regarding maintaining the List.

4. Recognize invalid:

Item 8 of the order of the State Customs Service of Ukraine of September 03, 2007 No. 728 "About approval of the Instruction on the organization of customs control and customs clearance of the international express departures which move (is sent) through customs border of Ukraine", registered in the Ministry of Justice of Ukraine on September 21, 2007 for No. 1081/14348.

5. This order becomes effective from the date of the introduction in action of the Customs code of Ukraine of March 13, 2012, but not earlier than day of official publication.

6. To impose control over the implementation of this order on the First Deputy Minister of Finance of Ukraine Myarkovsky A. I. and First Deputy Chairman of the State Customs Service of Ukraine of Dorokhovsky O. M.
