1. Approve the enclosed Procedure and terms of customs control and customs clearance of goods which move pipeline transport.

2. Approve the enclosed Procedure and terms of customs control and customs clearance of goods which move power lines.

3. Ceased to be valid according to the Order of the Ministry of Finance of Ukraine of 01.08.2024 No. 380

4. Determine what is temporary, for action of Item 9-33 of the Section XXI "Final and transitional provisions" of the Customs code of Ukraine and Items 1-1, 1-3 of the Section VI "Final provisions" of the Law of Ukraine "About alternative types of fuel":

1) the omission of amounts of the biomethane moved through customs border of Ukraine with pipeline transport is performed on the basis:

periodic customs declaration;

certificate of conformity to criteria of permanency of biomethane;

the documents confirming connection of the producer of biomethane to gas-transport or gas-distribution system with use of the automatic stream device (the automatic chromatograph), metering station of gas act and the scheme of differentiation of balance sheet accessory and operational responsibility of the parties, the act of input in commercial operation of gas metering station with use of the stream chromatograph (or separate acts of input in commercial operation of gas metering station and the chromatograph in case of arrangement of such devices separately);

the delivery-acceptance certificate of the made biomethane document which contains data on amounts of the made biomethane in energy units and units of volume signed by producer of biomethane and the operator of gas-distribution system or gas-transport system;

the act of the operator of gas storages of Ukraine of movement of the natural gas and/or biomethane in gas storages considered on the account of storage of the customer;

2) release in customs regime of export of amounts of the biomethane moved through customs border of Ukraine with pipeline transport is performed on the basis:

the additional declaration (additional declarations) with indication of exact data on the amounts of biomethane moved through customs border of Ukraine according to the periodic customs declaration;

proofs of stability of biomethane (Proof of Sustainability);

the general delivery-acceptance certificate of natural gas carriers - the document signed by operators of gas-transport system of Ukraine and the adjacent state which contains data on amount of the natural gas (biomethane, which when moving by pipeline transport according to the physical and chemical characteristics is replaced in the corresponding amount of natural gas or mix of natural gas and biomethane) moved through customs border of Ukraine (in case of availability amounts of balancing of natural gas and amounts of natural gas on transactions of bekhol are specified), with indication of conditional alphanumeric codes of identification of senders and receivers (shiper-couples);

references of the operator of gas-transport system of Ukraine concerning accounting of commercial giving and selections of natural gas and/or mix of gases, the customer's biomethane (producer of biomethane).

The documents determined by paragraphs the fifth, sixth subitem 1 and the paragraph the fifth subitem 2 of this Item are provided according to Item 1-1 of the Section VI "Final provisions" of the Law of Ukraine "About alternative types of fuel" during action of the decisions made by the Cabinet of Ministers of Ukraine according to Articles 16, 17 Laws of Ukraine "On foreign economic activity" concerning prohibition of export or quoting of commodity export according to the UKT foreign trade activities code 2711 21 00 00 respectively for the omission or release in customs regime of export of amounts of the biomethane moved through customs border of Ukraine with pipeline transport.

5. (Chmeruk M. O.) together with Department of the organization of customs control and registration of the State Customs Service of Ukraine (Syomk S. M.) in accordance with the established procedure to provide to department of tax, customs policy and methodology of financial accounting of the Ministry of Finance of Ukraine:

submission of this order on state registration in the Ministry of Justice of Ukraine;

promulgation of this order.

6. This order becomes effective from the date of the introduction in action of the Customs code of Ukraine of March 13, 2012, but not earlier than day of official publication.

7. To impose control over the implementation of this order on the First Deputy Minister of Finance of Ukraine Myarkovsky A. I. and First Deputy Chairman of the State Customs Service of Ukraine of Dorokhovsky O. M.
