About non-material cultural heritage of the Kyrgyz Republic

This Law establishes precepts of law in the field of protection and use of elements of non-material cultural heritage in the territory of the Kyrgyz Republic.

Article 1. Legislation of the Kyrgyz Republic on protection and use of non-material cultural heritage

The legislation of the Kyrgyz Republic on non-material cultural heritage consists of the Constitution of the Kyrgyz Republic, this Law published according to it other regulatory legal acts and also which came in the procedure established by the law into force of international treaties which participant is the Kyrgyz Republic.

Article 2. The basic concepts and terms used in this Law

In this Law the following concepts and terms are used:

non-material cultural heritage of the Kyrgyz Republic (further - non-material cultural heritage) - customs, traditional games, national sports, forms of representation and expression, knowledge and skills, and also the related tools, objects, artifacts and cultural spaces recognized as the people, communities, groups and, in certain cases, individuals as part of their non-material cultural heritage; elements of non-material cultural heritage - the values determined in this Law and which received the status of non-material elements of cultural heritage;

persons of law of property on elements of non-material cultural heritage - the Kyrgyz Republic, legal entities and physical persons, irrespective of patterns of ownership;

protection of non-material cultural heritage - taking measures for the purpose of ensuring viability of non-material cultural heritage, including its identification, documentation, research, preserving, protection, promoting, transfer by means of formal and informal education, increase in its role, and also revival of different aspects of such heritage;

authorized state body in the field of non-material cultural heritage (further - authorized state body) - the state body authorized by the Government of the Kyrgyz Republic by means of which state policy on preserving and use of non-material cultural heritage is performed;

The national list of elements of non-material cultural heritage of the Kyrgyz Republic (further - the National list) - the main instrument of the state inventory count of elements of non-material cultural heritage in the territory of the Kyrgyz Republic approved by the Government of the Kyrgyz Republic, including databank of elements of non-material cultural heritage;

archive of records of non-material cultural heritage - set of the records in the field of non-material cultural heritage executed on paper, electronic basis magnetic / TV tapes or by means of other materials which are stored in public organizations;

classification of elements of non-material cultural heritage - the procedure of determination of category of elements and their inclusion in the National list;

the file of non-material cultural heritage - obligatory documentation of each element of non-material cultural heritage for its inclusion in the National list, and also in the Representative list of non-material cultural heritage of mankind or in the List of the non-material cultural heritage needing urgent protection according to the International convention about protection of non-material cultural heritage;

"Master carrier" of material and spiritual traditions of national culture - the honourable title appropriated to persons who are acknowledged as society as the carriers of culture and traditional knowledge creating, storing and transferring elements of non-material cultural heritage by not changed traditional forms and means;

Intergovernmental committee of UNESCO on protection of non-material cultural heritage - the intergovernmental committee of UNESCO on protection of non-material cultural heritage consisting of 24 members of the participating countries elected by the General Assembly of the Convention of UNESCO on protection of non-material cultural heritage;

The representative list of non-material cultural heritage of mankind - the list constituted for ensuring bigger visualization of non-material cultural heritage, assistance to deepening of awareness of its value and encouragement of dialogue on the basis of respect of cultural diversity. The intergovernmental committee of UNESCO on protection of non-material cultural heritage, on the offer of the respective State Parties, constitutes, updates and publishes the Representative list of non-material cultural heritage of mankind;

The list of the non-material cultural heritage needing urgent protection - the list constituted for the purpose of acceptance of adequate measures of protection of the non-material cultural heritage needing urgent protection. The intergovernmental committee of UNESCO on protection of non-material cultural heritage constitutes, updates and publishes the List of the non-material cultural heritage needing urgent protection and includes such heritage in this List at the request of the respective State Party;

cultural space - the territory, the social and geographical circle representing unique zone of the most remained communication of material and non-material cultural heritage of the people;

representation forms - models of folk art (product from felt, chiya, tree, skin, etc.) as basic values of culture;

expression forms - first of all, the language, national songs, melodies (kyua) characterizing elements of non-material cultural heritage of the Kyrgyz people;

customs - the ethnocultural complex, rich on the content, form of collective experience of people which is remaining and reproduced on the basis of spatio-temporal transfer. Customs, to some extent, have the dominating value as are connected with the main milestones of human life: from the birth to funeral and funeral cycle;

ceremonies - part of spirituality and the way of life of people regulated by the religious and household representations having ritual properties;

traditional games - the games in the form of competitive activities which are historically created on the basis of national traditions, considering cultural, social and cultural wealth of the Kyrgyz people;

national sport - the sport which historically developed and created as component of culture of the Kyrgyz people, used by society for the purpose of harmonious development of the person, strengthening of his health and enhancement of its physical activity.

Article 3. Characteristic and types of non-material cultural heritage
