About the organizations of employers, their associations, the rights and guarantees of their activities

This Law determines the legal, economic and organizational principles of creation and organization activity of employers, their associations, features of legal regulation and guarantee of their activities, and also the basic principles of their government relations and local government bodies, labor unions and their associations, other associations of citizens, the companies, organizations and the organizations.

The law is directed to increase in role of the organizations of employers, their associations in forming and realization of the state social and economic policy, regulation of the employment, social, economic relationships, participations in social dialogue.

Section I General provisions

Article 1. Determination of terms

1. In this Law terms are used in such value:

the employer - the legal entity (the company, organization, the organization) or the physical person - the entrepreneur which within employment relationships uses work of physical persons;

the organization of employers - non-profitable public organization which unites employers;

merging of the organizations of employers - non-profitable public organization which unites the organizations of employers, their associations.

Article 2. Right of employers to consolidation

1. Employers have the right to unite in the organization of employers, to enter freely such organizations and to leave them, to take part in their activities on conditions and according to the procedure, determined by their charters.

2. The organizations of employers, their consolidation can create merging of the organizations of employers, enter such associations and to leave them, to participate in their activities on conditions and according to the procedure, the associations of the organizations of employers determined by charters.

3. The organization member of employers or merging of the organizations of employers has the right to stop the organizational membership of employers or merging of the organizations of employers by filing of application in the relevant authorized organs at any time. Article 3. Legislation of Ukraine on the organizations of employers, their associations

1. The legislation of Ukraine on the organizations of employers, their associations is based on regulations of the Constitution of Ukraine and consists of this Law, other legal acts, international treaties of Ukraine which are applied in Ukraine according to the procedure, provided by the law, and the regulatory legal acts adopted according to them.

Article 4. Law coverage

1. Operation of this Law extends to employers, the organizations of employers, merging of the organizations of employers, and also to the relations which arise between employers, the organizations of employers, their associations and public authorities, local government bodies within their powers determined by the legislation, and also labor unions, their organizations, associations.

2. Operation of this Law does not extend to associations of citizens which are created according to other laws of Ukraine, except specified in part one of this Article.

3. Determination "the organization of employers", "merging of the organizations of employers" and derivative of them can use only those organizations and their associations which are created and are effective according to this Law. The proper name of the organization of employers, merging of the organizations of employers shall contain information on their status.

Article 5. Purpose and tasks of the organizations of employers, their associations

1. The organizations of employers, their consolidation are created and are effective for the purpose of representation and protection of the rights and legitimate interests of employers in economic, social, labor and other spheres, including in their relations with other parties of social dialogue.

2. The main tasks of the organizations of employers, associations of the organizations of employers are:

1) providing representation and protection of the rights and legitimate interests of employers in the relations with executive bodies, local government bodies, labor unions, other public associations, the companies, organizations, the organizations and the bodies formed by them;

2) increase in competitiveness of national economy;

3) participation in forming and realization of economic, social policy of the state, regulation of economic, social, employment relationships;

4) assistance to growth in volumes of production and services;

5) assistance to creation of new workplaces;

6) cooperation with public authorities, authorities of the Autonomous Republic of Crimea, local government bodies, labor unions, their organizations and associations;
