1. Approve Regulations on procedure for carrying out employee assessment of public association of consumers it (is applied).

2. Make additions and changes to the following resolutions of Council of Ministers of the Republic of Belarus:

2.1. ceased to be valid according to the Resolution of Council of Ministers of the Republic of Belarus of 25.03.2022 No. 175

2.2. Ceased to be valid according to the Resolution of Council of Ministers of the Republic of Belarus of 25.06.2013 No. 527

3. This resolution becomes effective since August 11, 2012.

Regulations on procedure for carrying out employee assessment of public association of consumers

1. This Provision developed based on Item 3 of article 48 of the Law of the Republic of Belarus "About consumer protection" determines procedure for carrying out employee assessment of public association of consumers (further if other is not established, - certification).

2. In this Provision the term "worker" is used in the value established by the Labor code of the Republic of Belarus.

3. Certification is carried out for the purpose of realization on behalf of public association of consumers by the employee of public association of consumers (further if other is not established, – the worker) the rights provided in Item 3 of article 48 of the Law of the Republic of Belarus "About consumer protection"

4. Certification is carried out regarding check of knowledge by the worker of the legislation in the field of consumer protection.

5. Certification is carried out by the commission on employee assessment of public associations of consumers (further if other is not established, – the commission), quantitative and which members affirm the order of the Ministry of anti-monopoly regulation and trade. The commissions can be included representatives of other state bodies.

6. Commission chairman is the deputy minister of anti-monopoly regulation and trade. In the absence of the commission chairman of its power the vice-chairman of the commission, and in the absence of also vice-chairman of the commission – one of members of the commission according to the order of the Ministry of anti-monopoly regulation and trade performs.

7. Commission session is considered competent in the presence of at least two thirds of members of its structure.

8. Preparation of commission session, materials for consideration and record keeping are assigned to the secretary of the commission. In the absence of the secretary of the commission of its obligation one of members of the commission performs at the request of the commission chairman.

9. For carrying out certification the public association of consumers submits to the Ministry of anti-monopoly regulation and trade the statement for carrying out certification for form according to appendix 1.

For carrying out employee assessment of organizational structure of public association of consumers the statement gives public association of consumers which part the organizational structure is to the Ministry of anti-monopoly regulation and trade.

For decision making about carrying out certification the Ministry of anti-monopoly regulation and trade requests by means of the nation-wide automated information system from the state information resource "The Register of Individual Personal Accounts of Insured Persons in System of the Individual (Personified) Accounting in System of the National Social Insurance" of the data, the works of the certified persons confirming the fact in public association of consumers or the organizational structure which is its part.

10. Date, time and the venue of certification are appointed by the commission chairman. Certification shall be carried out no later than 20 calendar days from the date of receipt by the Ministry of anti-monopoly regulation and trade of the statement for carrying out certification.

The public association of consumers is informed on date, time and the venue of certification by the letter of the Ministry of anti-monopoly regulation and trade or by placement of information on the official site of the Ministry of anti-monopoly regulation and trade on the global computer Internet not later than three working days before date of certification.

Members of the commission are informed on date, time and the venue of certification by the secretary of the commission.

11. The worker is allowed to certification in case of presentation of the identity document.

12. Certification is carried out in the form of testing.

Questions for testing, versions of the correct answers and time allowed for conducting testing are developed by the commission and affirm its chairman.

Tests are created of 15 questions.

13. During testing the worker is forbidden to use regulatory legal acts, reference and special books, means of communication, to communicate with other certified.

After time allowed for conducting testing, the worker shall transfer the test of the commission, having signed it.

The worker who violated the requirements specified in this Item is considered not passed the test.

14. The basis for adoption by the commission of the decision on passing by the worker of certification is the test which is handed over to them with observance of requirements of parts one and the second Item 13 of this provision provided that the number of the correct answers makes at least 80 percent from quantity of the questions containing in the test. The answer in case of which of the offered answer options all true are chosen is considered correct and it is not chosen any incorrect answer option.

15. The decision on not passing by the worker of certification is made by the commission if:

there is no basis for decision making about passing by the worker of certification specified in Item 14 of this provision;

the public association of consumers submits the documents and (or) data which are not conforming to requirements of the legislation including false, forgery or invalid documents.

16. The commission makes the decision on passing or not passing by the worker of certification within three calendar days from the date of carrying out certification.
