About approval of the Procedure for creation of customs control zones

According to Article 330 of the Customs code of Ukraine of March 13, 2012 No. 4495-V, the subitem 64 of item 4 of the Regulations on the Ministry of Finance of Ukraine approved by the Presidential decree of Ukraine of April 8, 2011 No. 446, for the purpose of ensuring implementation by customs authorities of customs formalities I ORDER:

1. Approve the Procedure for creation of customs control zones which is applied.

2. (Chmeruk M. O.) and to Department of the organization of customs control and registration (Syomk S. M.) in accordance with the established procedure to provide to department of tax, customs policy and methodology of financial accounting of the Ministry of Finance of Ukraine:

submission of this order on state registration in the Ministry of Justice of Ukraine;

promulgation of this order.

3. This order becomes effective in 10 days from the date of its official publication.

4. To impose control over the implementation of this order on the First Deputy Minister of Finance of Ukraine Myarkovsky A. I. and First Deputy Chairman of the State Customs Service of Ukraine of Dorokhovsky O. M.

Procedure for creation of customs control zones

I. General provisions

1.1. This Procedure is developed according to part one of Article 330 of the Customs code of Ukraine.

The procedure determines the mechanism of creation of customs control zones (dalee-ZTK), and also designation ZTK and their borders.

1.2. In this Procedure terms and concepts are used in the values given in the Customs code of Ukraine.

II. Creation of ZTK

2.1. ZTK are created for the purpose of ensuring implementation by customs authorities of customs formalities concerning goods and vehicles which move through customs border of Ukraine.

ZTK are created by customs authority in which activities zone they are located, under approval:

at check points through frontier for automobile connection - with relevant organ of protection of frontier;

at check points (control Items) through frontier for sea, river, air and railway service - with relevant organ of protection of frontier and administration of sea and river ports, the airports and railway stations;

within boundary on frontier - with relevant organ of protection of frontier;

in sea and river ports, the airports, at railway stations, the territories of the companies - with administration of ports, the airports, railway stations and the companies;

in case of implementation of customs control in the places provided by part two of Article 220 of the Customs code of Ukraine - with heads of railway stations and relevant organ of protection of frontier;

in the territories of free customs zones of industrial type - with relevant organ of management of this zone;

on any site of the area within customs area of Ukrainysamostoyatelno.

The decision on creation of the customs control zone (further - the Decision) in form according to appendix 1 to this Procedure is signed by the head of the relevant customs authority or person authorized by it.

The decision is registered in the Magazine of registration of decisions on creation of customs control zones (further - the Magazine) in form according to appendix 2 to this Procedure. The magazine is kept by the department of the organization of customs control of customs or other division of customs determined by the head of customs.

After registration of the Decision, but prior to implementation by customs authorities of customs formalities, copies of the Decision are transferred (go) to representatives of all organizations with whom creation of specific ZTK agreed.

Storage duration of Decisions - three years after the termination of functioning of ZTK.

2.2. Permanent ZTK are created in case of regular placement in their territory of goods which are subject to customs control. Permanent ZTK can be created:

in certain places of check points (control Items) through frontier of Ukraine;

in the territories and in premises of customs, customs posts;

in the territories and in premises of the companies, cargo customs complexes, customs warehouses, warehouses of temporary storage, free customs zones, duty-free shops on condition of observance of requirements by them concerning providing the mode of the customs control zone and implementation of customs control in full;

in other places determined according to the Customs code of Ukraine.

Appendix to the Decision on creation of permanent ZTK is the plan scheme in which borders of permanent ZTK are reflected.

2.3. Temporary customs control zones are created for the period of implementation of customs control. Temporary ZTK can be created:

on aircrafts, parking of air vehicles, in halls of customs examination and other premises of the airports and airfields which are located within check points through frontier for air traffic;

in cars of passenger trains of foreign connection, on platforms of stations, in the territories of railway stations which are located within check points (control Items) through frontier for railway service;

in courts of foreign swimming, on moorings and other territories of sea and river ports which are located within check points (control Items) through frontier for sea and river connection;

in parking lots for vehicles which are not passed, within check points (control Items) through frontier for automobile connection;

in the territories and in premises of customs, customs posts;

in the territories and in premises of the companies, in warehouses of the organizatsiypoluchately humanitarian assistance on condition of observance of requirements by them concerning providing the mode of the customs control zone and implementation of customs control in full;

on objects of the companies which received authorization on simplification application "the procedure of release on the location", "the status of the authorized consignor", "the status of the authorized consignee", "the status of the authorized consignor of MDP" or "the status of the authorized consignee of MDP" - in case of adoption by customs authority of the Decision on need of implementation of customs examination on these objects;

in other places determined according to the Customs code of Ukraine.
