About flora

This Law governs the legal relations connected with protection, rational use and reproduction of flora, increase in its ecological, economic and resource potential in the territory of Turkmenistan.

Chapter I. General provisions

Article 1. The basic concepts used in this Law

For the purposes of this Law the following basic concepts are used:

flora – set of the growing wild-growing plants formed by them populations, vegetable communities and other plantings;

flora objects – the growing wild-growing plants formed by them populations, vegetable communities or other plantings;

resources of flora or natural vegetable resources – objects of flora or their property which are used or can be used when implementing of economic and other activity by legal entities or physical persons and have consumer value;

wild-growing and other plants – the plants growing in natural or in cultural regulated conditions for the purpose of preserving their types;

natural vegetable community or vegetable community – rather homogeneous set of wild-growing plants of different types of one or many generations which formed own internal circle with the structure and structure capable to natural reproduction or replaced by other vegetable community as a result of interaction between plants and the circle of their growth;

plants – vascular and Bryophyta of plant, alga, lichens and mushrooms;

vegetable products – used as raw materials or in other purposes of production and consumption the withdrawn wild-growing plants, their parts and (or) products of their life activity;

the circle of growth of objects of flora – the place of growth of objects of flora in total with other natural factors constituting the conditions of growth of objects of flora necessary for ensuring their life activity;

plantings – set of the wild-growing plants located in certain territory which both are forming and which are not forming vegetable community;

gardening – complex of actions for creation, content and reconstruction of the plantings which are carrying out sanitary and hygienic, recreational, technical, cultural, esthetic or other nonagricultural functions;

forest resources – inventories of wood of the minor wood resources, wild-growing fruits, nuts, mushrooms, berries, herbs, technical raw materials and other products of plant origin which are, accumulated and got in forest fund;

use of flora objects – use by legal entities and physical persons of objects of flora or their properties when implementing of economic and other activity by them;

users of the parcels of land – legal entities or physical persons to which according to the procedure, established by the legislation of Turkmenistan, the parcels of land in which borders flora objects are located are provided in property, use and lease;

the user of objects of flora – legal entity or physical person which according to the procedure, established by the legislation of Turkmenistan, is granted right to use by flora objects;

botanical collection – the systematized meeting documented and kept, including grown up, plants and (or) their parts, having scientific, teaching and educational, cultural and educational and esthetic value;

introduction of wild-growing plants – the activities directed to introduction of wild-growing plants to places behind borders of their natural distribution;

acclimatization of wild-growing and other plants – the activities aimed at providing adaptation of wild-growing and other plants to the new or changed circle of their growth;

hybridization of wild-growing and other plants – crossing of plants of different types for receipt of the posterity differing in certain heritable signs;

withdrawal – collection, procurement, change, cutting down or other actions directed to department of wild-growing plants from the place of their growth and (or) parts from wild-growing plants, both connected, and not connected with use of flora objects;

protection of objects of flora – set of the actions directed to preserving space, specific and population integrity of objects of flora, their number, resource potential and productivity, prevention of their damage, destruction or other negative impact on them;

protection of objects of flora – set of actions for protection of objects of flora against wreckers, diseases and impact of adverse factors of anthropogenous and natural nature;

reproduction of objects of flora – natural (regulated and non-regulated) or artificial process of renewal of objects of flora, recovery of their quality characteristics;

type – the main taxonomical unit combining the organisms similar among themselves and capable to crossing with each other;

flora – set of types of the plants growing in this or that certain territory.

Article 2. Legislation of Turkmenistan on flora

1. The legislation of Turkmenistan on flora is based on the Constitution of Turkmenistan and consists of this Law and other regulatory legal acts of Turkmenistan governing the relations in the field of protection, rational use and reproduction of flora.
