About approval of the Provision concerning implementation of risk analysis for development and/or review of phytosanitary actions

In pursuance of the order of the Cabinet of Ministers of Ukraine of 17.08.2011 "About approval of the actions plan on accomplishment in 2011 of the Nation-wide program of adaptation of the legislation of Ukraine to the European Union law", according to articles 14 of the Law of Ukraine "About quarantine of plants" I ORDER:

1. Approve the Provision concerning implementation of risk analysis for development and/or review of phytosanitary actions which is applied.

2. To department of agriculture (Demidov O. A.) submit the order on state registration to the Ministry of Justice of Ukraine.

3. This order becomes effective from the date of its official publication.

4. To impose control over the implementation of the order on the deputy minister Senya O. V.

Provision concerning implementation of risk analysis for development and/or review of phytosanitary actions

I. General provisions

1.1. This Provision determines conditions of carrying out risk analysis for development and/or review of phytosanitary actions.

1.2. Carrying out risk analysis is performed based on the International convention about protection of plants (further - MKZR), standards of the European and Mediterranean organization of protection of plants (further - EOKZR) and based on International standards on phytosanitary actions (No. 2 "Structure of the analysis of phytosanitary risk", No. 11 "The analysis of phytosanitary risk for quarantine wreckers, in particular risk analysis for the environment and risk which is caused with the live modified organisms", No. 21 "The analysis of phytosanitary risk for regulated not quarantine wreckers") (further - MSFZ) and this provision.

1.3. In this Provision terms are used in such value:

the risk analysis connected with review - risk analysis for potential regulated harmful organisms which is performed in case of need review of phytosanitary rules according to the current legislation of Ukraine;

the risk analysis connected with landing and seed material - risk analysis for determination of regulated not quarantine harmful organism, the plant intended for landing and vyseivaniye which can be by transfer of harmful organisms;

the risk analysis connected with harmful organism - the risk analysis for potential regulated harmful organisms performed after identification of harmful organism which can require application of phytosanitary actions;

risk analysis zone - accurately certain zone in the state for which risk analysis of harmful organism is carried out;

risk zone - zone in which ecological factors promote rooting of harmful organism whose presence at zone will lead to considerable economic losses;
