About consideration of claims to decisions of customs authority on refusal in customs clearance

For the purpose of creating favorable conditions for simplification of trade, increase in goods turnover through customs border of Ukraine and ensuring steady compliance with the law of Ukraine concerning the public customs affairs I ORDER:

1. Determine that are performed by customs authorities of arguments of claims of subjects of foreign economic activity to decisions on refusal in customs clearance in time which does not exceed 24 hours from the moment of receipt of such claims by customs authorities.

2. Determine Department of the organization of customs control and registration of State Customs Service of Ukraine responsible for coordination, accounting and control of responses to claims of subjects of foreign economic activity to decisions of customs authorities on refusal in customs clearance.

3. To provide to heads of customs authorities:

objective and comprehensive check of arguments of claims to decisions of customs authorities on refusal in customs clearance and adoption of relevant decisions in time which does not exceed 24 hours from the moment of receipt of such claims by customs authorities;

in cases of wrongful acts of officials of customs authorities - acceptance of immediate measures for the termination of such actions;

ensuring renewal of the violated rights and real accomplishment of the decision made in connection with the claim;

identification and elimination of the reasons and conditions which promoted wrongful acts of officials of customs authorities;

holding personal meetings with heads (representatives) of subjects of foreign economic activity whose claims are considered;

informing Department of the organization of customs control and registration of State Customs Service of Ukraine within two hours about receipt of the claim to the decision of customs authority on refusal in customs clearance and within two hours - about results of consideration of this claim.

4. To the director of the department of the organization of customs control and registration of State Customs Service of Ukraine:

provide monitoring and the analysis of situation on consideration of claims of subjects of foreign economic activity to decisions of customs authorities on refusal in customs clearance;

information on the state of affairs on consideration of claims of subjects of foreign economic activity to decisions of customs authorities on refusal in customs clearance to give in the form of the daily operational reference to management of the State Customs Service of Ukraine.

5. To impose control over the implementation of the order on the First Deputy Chairman of the State Customs Service of Ukraine of Dorokhovsky O. M.
