ORDER OF THE GOVERNMENT OF THE KYRGYZ REPUBLIC

Questions of Fund for management of state-owned property under the Government of the Kyrgyz Republic

(as amended on 08-08-2018)

According to the resolution of Jogorku Kenesh of the Kyrgyz Republic "About structure of the Government of the Kyrgyz Republic" of December 23, 2011 No. 1452-V, and also the order of the Government of the Kyrgyz Republic "About organizational measures in connection with approval of new structure of the Government of the Kyrgyz Republic" of December 30, 2011 the No. 762 Government of the Kyrgyz Republic decides:

1. Approve:

- Regulations on Fund for management of state-owned property under the Government of the Kyrgyz Republic (appendix 1);

the paragraph third ceased to be valid according to the Order of the Government of the Kyrgyz Republic of 30.08.2012 No. 595

- the scheme of management of Fund for management of state-owned property under the Government of the Kyrgyz Republic (appendix 3).

2. Reorganize in the procedure established by the legislation Management of the property relations, Northern territorial administration and the Southern territorial administration of Fund for management of state-owned property under the Government of the Kyrgyz Republic by accession to Fund for management of state-owned property under the Government of the Kyrgyz Republic.

3. Establish:

- that the Fund for management of state-owned property under the Government of the Kyrgyz Republic is legal successor of the Ministry of state-owned property of the Kyrgyz Republic, except for functions of development of policy of management of state-owned property;

- ceased to be valid according to the Order of the Government of the Kyrgyz Republic of 30.08.2012 No. 595

4. To the Ministry of Finance of the Kyrgyz Republic to perform financing of Fund for management of state-owned property under the Government of the Kyrgyz Republic, according to the approved expense budget.

5. Ceased to be valid according to the Order of the Government of the Kyrgyz Republic of 03.10.2017 No. 641

6. Recognize invalid:

- Item 3 of the order of the Government of the Kyrgyz Republic "About the organization of activities of the state company "National integration of national art crafts of Kyyal of September 13, 2011.

7. To fund for management of state-owned property under the Government of the Kyrgyz Republic to bring the decisions into accord with this resolution.

8. This resolution becomes effective from the date of official publication.

Regulations on Fund for management of state-owned property under the Government of the Kyrgyz Republic

1. General provisions

1. The fund for management of state-owned property under the Government of the Kyrgyz Republic (further - Fund) is the state body of the executive authority of the Kyrgyz Republic representing the interests of the state as the owner of state-owned property, providing realization of state policy on management and privatization of state-owned property.

2. The fund in the activities is guided by the Constitution of the Kyrgyz Republic, the laws of the Kyrgyz Republic, other regulatory legal acts of the Kyrgyz Republic and this Provision.

3. The fund is legal entity, has seal with the image of the State Emblem of the Kyrgyz Republic with the name in the state and official languages, and also accounts in system of Treasury and in agent banks of the Central Treasury of the Ministry of Finance of the Kyrgyz Republic.

4. The purpose of Fund is ensuring efficiency of use, management and privatization of state-owned property.

3. Tasks of fund

5. Tasks of Fund are:

- realization of policy of management and order of state-owned property and privatizations of state-owned property;

- accounting and inventory count of state-owned property;

- ensuring protection of property rights and interests of the Kyrgyz Republic.

4. Functions Fonda

6. The fund performs the following functions:

1) functions on realization of industry policy:

- introduction of offers in case of development of privatization programs of state-owned property, on enhancement of the regulatory legal acts regulating questions of privatization, management, the order and rational use of state-owned property;

- implementation in accordance with the established procedure transfers of state-owned property to economic maintaining, operational management, lease, use, pledge and trust management;

- accounting (monitoring) and the analysis of financial and economic condition large, economically or socially important business entities with the state participation;

- accounting and maintaining the register of the privatized objects;

- monitoring of dynamics and analysis of process of privatization, course of program implementation of privatization of state-owned property;

- obtaining and money transfer from privatization, dividends, lease and other receipts in accordance with the established procedure;

- in compliance with competence decision making about implementation of privatization of objects of state-owned property;

- holds events for legal promotion in the sphere of the supervised industry;

2) regulation functions:

- implementation of functions of the state on performance as the founder of legal entities and the shareholder (participant) in economic societies with the state ownership ratio;

- consent to public institutions and the companies on performance as founders of the created legal entities and their secession of founders;

- consent to public authorities, the state companies, organizations and the organizations on real estate acquisition and vehicles;

- implementation of practical measures on acceptance in property of the state nationalized and otherwise the property turned into state-owned property, to its use, management and the order;

- implementation of practical measures on privatization of state-owned property;

- implementation of inventory count and accounting of state-owned property;

- consent to the state companies on write-off of fixed assets in accordance with the established procedure;

3) functions of coordination and control:

- coordination of activities of the subordinated organizations;

- implementation of measures for increase in efficiency of corporate management;

- forming and maintaining the dividend database, control and measures for ensuring timely dividend payout;

- ensuring timely payment of the rent for leased state-owned property;

- creation and participation in work of the commissions on privatization, transfer of state-owned property to municipal;
