About features of implementation of purchase for public funds of services of mail service, stamps and the marked envelopes

Article 1. Determination of terms

1. In this Law terms are used in the value determined in the laws of Ukraine "About implementation of public procurements" and "About mail service".

Article 2. Procedure for procurement of services of mail service, stamps and the marked envelopes

1. Purchase of services of mail service, stamps and the marked envelopes is performed by application of procurement procedure for one participant according to article 39 of the Law of Ukraine "About implementation of public procurements".

2. The customer within one working day from day of decision making about application of procurement procedure for one participant provides the publication in the state official printing publication concerning public procurements and placement on web portal of Authorized body concerning purchases of information on application of procurement procedure for one participant.

3. The aggregate term necessary for determination of the winner of procurement procedure at one participant, shall not exceed three working days from the date of publication in the state official printing publication concerning public procurements of information on application of the specified procedure.

4. The customer accepts the offer on results of application of procurement procedure for one participant in day of determination of the winner. The message on the acceptance of the offer surely free of charge is published in the state official printing publication concerning public procurements.

5. The customer has the right to sign the purchase agreement of services of mail service, stamps and the marked envelopes by results of application of procurement procedure for one participant not earlier than in five days from the date of publication in the state official printing publication concerning public procurements of the message on the acceptance of the offer on results of application of procurement procedure for one participant.

Article 3. The purchase agreement of services of mail service, stamps and the marked envelopes

1. The purchase agreement of services of mail service, stamps and the marked envelopes consists in writing according to provisions of Civil and Economic codes of Ukraine taking into account the features determined by the laws of Ukraine "About implementation of public procurements" and "About mail service".

2. Essential terms of the contract about purchase of services of mail service, stamps and the marked envelopes are:

subject of the agreement (name, nomenclature, assortment, nominal);

quantity of stamps, the marked envelopes and services of mail service and the requirement concerning their quality;

payment procedure;

the amount determined in the agreement;

the term and the place of delivery of stamps, the marked envelopes and provision of services of mail service;

duration of the agreement;

rights and obligations of the Parties;

specifying of condition concerning possibility of reduction of purchasing amounts depending on the actual amount of financing of expenses;

responsibility of the parties.

Article 4. Final provisions

1. This Law becomes effective from the date of, its publication following behind day.
