About approval of the Instruction on the organization and implementation of verification of documents of citizens of Ukraine, the foreigners and stateless persons crossing frontier

According to Articles 3 - 7 Laws of Ukraine "About border control", the subitem 3 of item 4 of the Regulations on Administration of the State Border Service of Ukraine approved by the Presidential decree of Ukraine of April 06, 2011 No. 399, the subitem 7 of Item 5 of the Actions plan on implementation of the Concept of the integrated management of borders approved by the order of the Cabinet of Ministers of Ukraine of January 05, 2011 No. 2-r for the purpose of determination of practical actions and policy strokes of actions of staff of the State Border Service of Ukraine for verification of documents of citizens of Ukraine, foreigners and stateless persons during implementation of border control of PRIKAZYVAYU:

1. Approve the Instruction on the organization and implementation of verification of documents of citizens of Ukraine, the foreigners and stateless persons crossing frontier which is applied.

2. To chiefs of regional governments, bodies of protection of frontier of the State Border Service of Ukraine:

2.1. Organize studying of this Instruction with officers of headquarters of regional governments, staff of bodies and divisions of protection of frontier in the part concerning them.

2.2. At staff which is used in service of border duties at check points through frontier to accept offsettings on knowledge of this Instruction and ability practically it to apply during implementation of verification of documents of citizens of Ukraine, the foreigners and stateless persons crossing frontier.

3. To the chief of the Main expert and criminalistic center of the State Border Service of Ukraine to provide transmission of messages about descriptions of samples of forms of documents and cautions about the counterfeits revealed in them in the Portable Document Format (PDF) format to regional governments, bodies of protection of frontier, National academy of the State Border Service of Ukraine of Bogdan Khmelnytsky, Training center of the State Border Service of Ukraine through official e-mail addresses in the Intranet of the State Border Service of Ukraine network.

4. Take measures concerning ensuring use of messages on descriptions of samples of forms of documents and cautions about the counterfeits revealed in them only in office activities and non-admissions of their distribution and copying for use not to destination.

5. In accordance with the established procedure to submit to management of border control and registration of Department of protection of frontier this order on state registration to the Ministry of Justice of Ukraine.

6. To impose control over the implementation of this order on the First Deputy Chairman of the State Border Service Ukrainydirektor Departament of protection of frontier, chiefs of regional governments and bodies of protection of frontier.

7. The order becomes effective from the date of official publication, except the Section ІІІ this Instruction, becoming effective for check points through frontier for automobile and air connection since July 15, 2012, and for check points through frontier for the railway, sea, ferry and river service since September 01, 2012.

І. General provisions

1.1. This Instruction determines the general principles of the organization and implementation of verification of documents of citizens of Ukraine, the foreigners and stateless persons crossing frontier.

1.2. Terms which are used in this Instruction have such values:

verification of documents - research authorized officials of the State Border Service of Ukraine of passport and other documents of citizens of Ukraine, the foreigners and stateless persons crossing frontier for the purpose of establishment of their reality and accessory to the corresponding person;

profound verification of documents - research of passport and other documents of citizens of Ukraine, foreigners and stateless persons which is performed for the purpose of confirmation or confutation of signs of their counterfeit (falsification);

standard verification of documents - research of passport and other documents of citizens of Ukraine, foreigners and stateless persons in the amount necessary for determination of legal causes for crossing of frontier by them.

1.3. Other terms which are used in this Instruction are applied in the values provided in the Laws of Ukraine "About the State Border Service of Ukraine", "About border control", "About legal status of foreigners and stateless persons".

1.4. The system of verification of documents of citizens of Ukraine, the foreigners and stateless persons crossing frontier consists of three levels:

the first level - standard verification of documents;

the second level - profound verification of documents;

the third level - expert research of passport documents.

ІІ. Implementation of standard verification of documents

2.1. Standard verification of documents is performed by authorized officials of divisions of protection of frontier, the acting as in border duty "Verification of documents".

2.2. Before implementation of standard check officials of divisions of protection of frontier are allowed:

had special training in the relevant educational institutions of the State Border Service of Ukraine;

owning practical skills on identification of person according to the photo (facsimile) in the passport document of the bearer and recognition of signs of counterfeit (falsification) of documents;

to which the admission to independent service in border duty "Verification of documents" is provided.

2.3. Standard verification of documents is performed:

2.3.1. At check points through frontier (control Items) (further - check points):

on the line of passport control;

in vehicles of foreign following;

in parking lots of vehicles of foreign following.

2.3.2. Out of check points:

in places for monitoring procedure of persons;

in specially certain zones of control in the territory of sea (river) ports, the fishing companies, moorings (piers).

2.3.3. In the territory of the adjacent states in the places determined by subitem 2.3.1 of this Item if it is provided by international treaties.
