1. Approve the enclosed Rules of utilization of the space objects and technical means taken out of service.

2. This resolution becomes effective after ten calendar days after the first official publication.

Rules of utilization of the space objects and technical means taken out of service

1. General provisions

1. These rules of utilization of the space objects and technical means taken out of service (further - Rules), are developed according to the Law of the Republic of Kazakhstan of January 6, 2012 "About space activities" and determine procedure for utilization of the space objects and technical means taken out of service.

Utilization, and also realization, transfer, accounting and write-off of the utilized space subjects and technical means of military (double) appointment are performed according to the legislation on defense of the Republic of Kazakhstan.

2. In these rules the following basic concepts are used:

1) utilization - final stage of lifecycle of space objects and technical means which represent complex of the organizational and technical actions and engineering procedures providing dismantle, dismantling, conversion of space objects out of service and the technical means which developed the resource, physically obsolete, liquidated according to contractual commitments for the purpose of their effective use for the benefit of economic requirements and receipts of additional products and raw materials;

2) technical means - the equipment of any kind (mechanical, electric, electromagnetic, electronic) which is part of space systems and space missile systems and providing their normal functioning at all operational phases.

2. Procedure for utilization

3. Utilizations are subject:

1) spacecrafts, the corresponding prototypes and educational and training means after the expiration of warranty periods of their storage;

2) the equipment of carrier rockets, accelerating blocks and spacecrafts (including placed on manufacturing plants);

3) the technical means which are released in case of reconstruction or capital repairs;

4) the components of technical means taken out of service;

5) landers and capsules of spacecrafts after proper use and return to Earth.

4. The basis for representation of space objects and technical means on utilization are:

1) the expiration of the useful lives determined by the specifications and technical documentation;

2) physical wear (before the expiration of useful lives);

3) planned replacement of the obsolete equipment;

4) economic inexpediency of carrying out repair and recovery owing to impact of adverse climatic factors, natural disasters, the fires;

5) lack of need of use for the intended purpose.

5. For utilization of space objects and technical means the physical and (or) legal entities performing space activities send lists of the space objects and technical means which are subject to utilization to authorized body in the field of space activities (further - authorized body) in which are specified:

1) name, index;

2) year of release;

3) serial number (in the presence);

4) quantity;

5) availability of components;

6) location or place of warehousing;

7) availability of technical documentation.

6. The authorized body after receipt of lists of the space objects and technical means which are subject to utilization sends them in a month to the organizations which are under authority of authorized body for determination of need for space objects and technical means.

7. The organizations which are under authority of authorized body after receipt of lists of the space objects and technical means which are subject to utilization send in a month the written request of any form to authorized body on the need for the corresponding space objects and technical means or in writing report that about absence.

8. The authorized body after receipt of requests for the need for space objects and technical means will organize, transfer of the space objects and technical means which are subject to the utilization, the organizations which are under authority of authorized body, according to the procedure, established:

1) the civil legislation of the Republic of Kazakhstan - for the space objects and technical means which are in private property;

2) the legislation of the Republic of Kazakhstan on state-owned property - for the space objects and technical means which are in state-owned property.

9. In case of receipt by authorized body of messages on lack of the need for space objects and technical means, these space objects and technical means are subject to utilization what the authorized body within two months in writing notifies the physical and (or) legal entities specified in Item 5 of these rules on.

10. Utilization of space objects and technical means is performed in the following directions:

1) use of separate systems and elements of space objects and technical means as industrial products and consumer goods;

2) use of components of utilizable space objects and technical means in case of upgrade and production of new samples;

3) use of the equipment, aggregates, nodes, details and materials of utilizable samples of space objects and technical means as reserve products and devices;

4) use of the equipment, aggregates, nodes, details and materials of utilizable samples of space objects and technical means as the laboratory equipment of educational institutions and training centers on training of specialists of space industry;

5) industrial conversion of utilizable space objects and technical means and use in production, other industries of economy of products of utilization (scrap of ferrous, non-ferrous and precious metals, materials and substances).

11. Process of the organization and work on utilization of space objects and technical means includes the following main stages:

1) reduction of space objects and technical means in safe condition;

2) check on availability of security documents (in case of need);

3) declassification (in case of need);

4) licensing and/or certification (in case of need);

5) implementation of activities is direct on utilization.
