4. To impose control of execution of this order on the first vice-minister of the industry and new technologies of the Republic of Kazakhstan Rau A. P.

5. This order becomes effective after ten calendar days after day of its first official publication.

Regulations of Admission, registration and considerations of the request for provision of investment preferences

1. General provisions

1. These rules of acceptance, registration and consideration of the request for provision of investment preferences (further - Rules) determine procedure for acceptance, registration and consideration of the request for provision of investment preferences by authorized body by investments.

2. In these rules the following concepts are used:

1) authorized body on investments (further - authorized body) - the state body determined by the Government of the Republic of Kazakhstan according to the conclusion of investment contracts and control of their execution;

2) the applicant - the legal entity of the Republic of Kazakhstan who submitted the application for provision of investment preferences for implementation of the investment project or the investment strategic project in priority types of activity.

2. Acceptance and registration of the request

3. The request for provision of investment preferences (further - the Application) is submitted by the applicant to office of authorized body, is registered with assignment of registration number and date then it is transferred to the first head of authorized body or its deputy.

4. The head of authorized body or its deputy transfer the Request to the division of authorized body which is directly performing consideration of the Request (further - division of authorized body) on compliance to requirements of the Law of the Republic of Kazakhstan "About investments" of January 8, 2003 (further - the Law).

3. Consideration of the request

5. The term of consideration of the Request regarding provision of investment preferences constitutes twenty working days.

6. By consideration of the request regarding provision of investment preferences division of authorized body:

1) considers the Request for provision of investment preferences;

2) is checked by availability of the documents specified in article 19 of the Law of the Republic of Kazakhstan "About investments";

Carries out 3) the analizbusiness-plan of the investment project or the investment strategic project;

4) is determined by availability of sources and guarantees of financing of the investment project or investment strategic project;

5) is carried out by analizotsutstviye of tax debt, debt on compulsory pension contributions and social assignments;

6) interacts with state bodies and other organizations for investment questions (approval).

7. By results of consideration of the request the authorized body makes the decision on provision or on refusal in provision of investment preferences about what to the applicant the written answer goes. The decision on refusal in provision of investment preferences shall be motivated.
