1. Approve the enclosed Rules of creation and operation (application) of space systems in the territory of the Republic of Kazakhstan, and also in space.

Rules of creation and operation (application) of space

1. General provisions

1. These rules of creation and operation (application) of space systems in the territory of the Republic of Kazakhstan, and also in space (further - Rules) are developed according to the Law of the Republic of Kazakhstan of January 6, 2012 "About space activities" and determine procedure for creation and operation (application) of space systems in the territory of the Republic of Kazakhstan, and also in space.

2. In these rules the following basic concepts are used:

1) the collaborator - person performing delivery of goods (performance of works, rendering services) for project implementation under the agreement (contract) with the contractor;

2) the initiator of the project - the physical person or legal entity (the central state bodies of the Republic of Kazakhstan, other public institutions, the legal entities registered in accordance with the established procedure in the territory of the Republic of Kazakhstan, and also the foreign and international organizations) making the decision to initiate the project in the field of space activities (further - the project);

3) the contractor - person responsible for management of development and project implementation in the field of space activities, including for development of necessary documentation on creation and operation of space objects and objects of land space infrastructure;

4) the customer - the organization (the state body, public institution, the state company, the legal entity registered in accordance with the established procedure in the territory of the Republic of Kazakhstan and also the foreign and international organizations) for the benefit of which the space system and which approved the specification on creation of space system or its components is created if they are created separately from specific space system;

3. The organizations participating in creation and operation (application) of space systems and components carry out works according to the legislation of the Republic of Kazakhstan, requirements in the field of ecology, technical regulation, ensuring unity of measurements and sanitary and epidemiologic requirements of the Republic of Kazakhstan.

4. The organization of process of creation and operation (application) of space systems of military and dual purpose is determined by the regulatory legal acts regulating process of accomplishment of the state defense order and operation of arms, military equipment, goods and technologies of double application (appointment).

5. Creation and operation (application) of space systems, and also separate components of systems if they are created (are modernized) separately from specific space system, performed according to specifications of the customer.

6. Organization activity of the Republic of Kazakhstan on creation, operation (application) of space systems with participation of the foreign organizations is performed according to these rules and taking into account the obligations of the Republic of Kazakhstan following from participation of the Republic of Kazakhstan in international treaties.

7. Financing of activities for creation of space systems is performed from the republican budget and (or) other sources.

8. Creation of space systems is performed according to article 15 of the Law of the Republic of Kazakhstan of January 6, 2012 "About space activities" and includes:

1) scientific developments (preproject researches, development of the specification);

2) designing (analysis of mission of space system, determination of feasibility of the project, outline designing, detailed designing);

3) production (production and testing of component parts and devices, assembly and autonomous testing of components of space systems);

4) construction (buildings and constructions for land complexes of space systems);

5) installation (processing equipment of land complexes of space systems);

6) testing of space systems (start of spacecrafts, carrying out flight space and test testing);

7) commissioning of space systems.

9. Scientific developments are performed according to the legislation of the Republic of Kazakhstan in the field of science, and also according to article 14 of the Law of the Republic of Kazakhstan "About space activities".

10. The analysis of mission of space system is performed by the initiator of the project, the contractor and representatives of end users and includes:

1) problem definition, implemented during project development, proceeding from financial and technological capabilities, and also conditions of ensuring reliability, safety, operational restrictions;

2) development of preliminary technical specifications on space system in general and its components;

3) creation of master plans, works schedules, determination of the main collaborators;

4) marketing researches on improvement of financial attractiveness of the project;

5) provisional estimate of risk.

11. Determination of feasibility of the project is performed by the contractor and collaborators and includes:

1) plan development of management of the project, plan of system engineering and the plan of quality assurance of products (space system and its components), including plans for ensuring reliability and safety;

2) development of system and operational concepts and architecture of space system, their check on compliance to requirements, determination of levels of uncertainty and risk;

3) assessment of possibility of accomplishment of technical and organizational concepts by identification of the restrictions relating to realization, cost, scheduled plans, the organization, production, operation, servicing;
