to the Decision of Council of the Eurasian economic commission of July 16, 2012 No. 54

COMMON CUSTOMS TARIFF OF THE EURASIAN ECONOMIC UNION

(as amended on 21-02-2020)

Common customs tariff of the Eurasian Economic Union (CCT EEU) - the code of rates of the import customs duties applied to the goods imported (imported) on customs area of the Eurasian Economic Union from the third countries, systematized according to the single Commodity nomenclature of foreign economic activity of the Eurasian Economic Union.

Basic rules of interpretation of the Commodity Nomenclature of Foreign Economic Activity

Classification of goods in the Commodity nomenclature of foreign economic activity (Commodity Nomenclature of Foreign Economic Activity) is performed by the following Rules:

1. Names of Sections, groups and subgroups are provided only for usability of the Commodity Nomenclature of Foreign Economic Activity; for the legal purposes classification of goods in the Commodity Nomenclature of Foreign Economic Activity is performed proceeding from texts of goods items and the corresponding notes to Sections or groups and if such texts do not provide other, according to following provisions:

2. a) Any reference in the name of goods item to any goods shall be considered and as the reference to such goods in incomplete or incomplete type provided that, being presented in the incomplete or incomplete form, these goods have the main property of complete or complete goods, and also shall be considered as the reference to the complete or complete goods (or classified in the considered goods item as complete or complete owing to this Rule) presented in not collected or sorted form.

b) Any reference in the name of goods item to any material or substance shall be considered and as the reference to mixes or compounds of this material or substance with other materials or substances. Any reference to goods from certain material or substance shall be considered and as the reference to the goods fully or partially consisting of this material or substance. Classification of the goods consisting more than of one material or substance is performed according to Rule 3 provisions.

3. If owing to the Rule 2 (b) or for any other reasons is available, prima facie, possibility of reference of goods to two or more goods items, classification of such goods is performed as follows:

a) Preference is given to that goods item which contains the most specific description of goods, in comparison with goods items with more general description. However when each of two or more goods items is related only to part of the materials or substances which are part of mix or multicomponent product or only to part of the goods provided in set for retail sale, these goods items shall be considered equivalent in relation to these goods even if one of them gives more complete or exact description of goods.

b) Mixes, the multicomponent products consisting of different materials or made of different components and the goods provided in sets for retail sale which classification cannot be performed according to provisions of the Rule 3 (a) shall be classified by that material or component which give to these goods the main property provided that this criterion is applicable.

c) Goods which classification cannot be performed according to provisions of the Rule 3 (a) or 3 (b) shall be classified in goods item, the last in ascending order of codes among goods items, equally acceptable for consideration in case of classification of these goods.

4. Goods which classification cannot be performed according to provisions of the above Rules are classified in the goods item corresponding to the goods (close) to the most similar to the considered goods.

5. In addition to above-mentioned provisions the following Rules shall be applied to named below goods:

a) Covers and cases for cameras, musical instruments, guns, drawing accessories, necklaces, and also the similar container having the special form or adapted for placement of the corresponding product or set of products suitable for long-term use and provided together with products for which it is intended shall be classified together with the products packed into them if such type the container usually goes on sale together with these products. However this Rule is not applied to container which, forming whole with packed item, gives the last the main property.

b) On condition of observance of provisions of the above-stated Rule 5 (a) the packaging materials and container delivered together with the goods which are in them shall be classified jointly if they such type which is usually used for packaging of these goods. However this provision is not obligatory if such packaging materials or container with all evidence are suitable for reuse.

6. For the legal purposes classification of goods in subline items of goods item shall be performed according to the names of subline items and notes concerning subline items, and also, mutatis mutandis, provisions of above-mentioned Rules provided that only subline items at one level are comparable. For the purposes of this rule the corresponding notes can be also applied to Sections and groups if in context other is not stipulated.

Group 02. Meat and food meat offal

Notes:

1. Do not join in this group:

(a) products of goods items 0201 - 0208 either 0210, unsuitable or not suitable for consumption;

(b) guts, bubbles or stomachs of animals (goods item 0504) or blood of animals (goods item 0511 or 3002); or

(c) animal fat, except products of goods item 0209 (group 15).

Additional notes:

1. (A) The listed below terms mean:

(a) "carcasses of cattle" in subline items 0201 10 and 0202 10 - the whole flourishes of the slaughtered animals after bleeding, nutrovka and the removals of skin imported with-headed or brainless with legs or without legs, with other not separated offal or without them. If hulks are imported brainless, then the last shall be separated ink in atlantozatylochny joint. When importing hulks without legs the last shall be chopped off in carpal and metacarpal or zaplusne-plusnevy joint; "hulk" shall include front part of ink with all bones and neck, and cervical part and topribs shall contain more than 10 pairs of edges;

(b) "half carcasses of cattle" in subline items 0201 10 and 0202 10 - the product which is turning out as a result of symmetric razrub of the whole ink on the center of everyone cervical, chest, lumbar and sacral vertebrae and on the center of breast and sciatic and pubic union; "half carcass" shall include front part of half carcass with all bones and neck, and cervical part and topribs shall contain more than 10 edges;

(c) "the compensated quarter timbers" in subsubline items 0201 20 200 and 0202 20 100 - the part of ink consisting:

- or from front quarter timber with all bones and neck, with the cervical part and topribs which is chopped off at the level of the tenth edge, and back quarter timber with all bones, with hip and okovalok, chopped off at the level of the third edge;

- or from front quarter timber with all bones and neck, with the cervical part and topribs which is chopped off at the level of the fifth edge with all Pashina and breast cut, and back quarter timber with all bones, with hip and okovalok, chopped off at the level of the eighth edge.

The front and back quarter timbers constituting "the compensated quarter timbers" shall be delivered for import at the same time and in equal quantity, and the lump of front quarter timbers shall be equal to the lump of back quarter timbers. At the same time certain discrepancy in the mass of two parts of batch no more than 5% of the mass of heavier part of batch (front or back quarter timbers) is allowed;

() "undivided front quarter timbers" in subsubline items 0201 20 300 and 0202 20 300 - front part of ink with all bones and neck, with cervical part and topribs, numbering al least four pairs and at most ten pairs of edges (the first four pairs of edges shall be whole, the others can be split), from Pashina or without Pashin;

(e) "the divided front quarter timbers" in subsubline items 0201 20 300 and 0202 20 300 - the front part of half carcass with all bones and neck, cervical part and topribs numbering al least four edges and at most ten edges (the first four edges shall be whole, the others can be split), from Pashina or without Pashin;

(e) "undivided back quarter timbers" in subsubline items 0201 20 500 and 0202 20 500 - back part of ink with all bones, with hip and okovalok, including loin, numbering al least three pairs of whole or split edges, with shank or without shank, from Pashina or without Pashin;

(g) "the divided back quarter timbers" in subsubline items 0201 20 500 and 0202 20 500 - back part of half carcass with all bones, with hip and okovalok, including loin, numbering al least three whole or split edges, with shank or without shank, from Pashina or without Pashin;

(h) (1) juncture "shovel" and "cervical and scapular part" in subsubline item 0202 30 500 - the back part of front quarter timber including the upper part of the chine of scapular part, received from front quarter timber minimum with four and as much as possible with ten edges by razrub of ink in a straight line through point of joint of the first edge with the first segment of breast to point of bending of diaphragm on the tenth edge;

(2) juncture "breast cut" in subsubline item 0202 30 500 - the lower part of front quarter timber including the rear edge of breast cut and first line of breast cut.

(B) the Products mentioned in the additional note 1 (A) (and-) to this group, can be provided both with backbone, and without it.

(C) In case of determination of number of the whole or split edges according to Item 1 (A) only those edges which are not separated backbone are taken into consideration. In case the backbone is absent, then it is necessary to consider only the whole or split edges which were connected to the absent backbone.

2. (A) The listed below terms mean:

(a) "hulks or half carcasses" in subsubline items 0203 11 100 and 0203 21 100 - the slaughtered pigs in the form of carcasses of domestic pigs after bleeding and nutrovka, removal of bristle and hoofs. Half carcasses are hit by splitting of the whole ink on cervical, chest, lumbar and sacral vertebras and along breast and sciatic and pubic union. The whole flourishes or half carcasses can be with-headed or brainless, with legs, renal fat, kidneys, tail, diaphragm or without them. In half carcasses can be removed or the spinal cord, brain or language are not removed. In the whole flourishes and half carcasses of sows the udder (mammary glands) can be left or removed;

(b) "gammon" (back gammon) in subsubline items 0203 12 110, 0203 22 110, 0210 11 110 0 and 0210 11 310 0 - back (tail) part of half carcass, including bones, with leg or without leg, with shank, skin and subcutaneous fat or without them.

Gammon (back gammon) separates from other part of half carcass on the line taking the most bigger the last lumbar vertebra;

(c) "first line" in subsubline items 0203 19 110, 0203 29 110, 0210 19 300 0 and 0210 19 600 0 - front (head) part of brainless half carcass, including bones, with leg, hough, skin and subcutaneous fat or without them.

The first line separates from other part of half carcass on the line taking the most bigger the fifth chest vertebra.

The upper (back) part of first line which is containing or not containing scapular bone with the attached muscles (fresh cervical part or cervical part of bacon half in salty type), is considered juncture of brisket if it separates from the lower (belly) part of first line by razrub the most bigger on the line passing directly under backbone;

() "shovel" (front gammon) in subsubline items 0203 12 190, 0203 22 190, 0210 11 190 0 and 0210 11 390 0 - the lower part of first line which is containing or not containing scapular bone with the attached muscles including bones, with hough, skin and subcutaneous fat or without them.

The scapular bone with the attached muscles imported separately belongs to this subsubline item as part of front gammon;

(e) "brisket" in subsubline items 0203 19 130, 0203 29 130, 0210 19 400 0 and 0210 19 700 0 - the upper part of half carcass from the first cervical vertebra to tail vertebrae, including bones, with cutting, scapular bone, subcutaneous fat, skin or without them.

Brisket separates from the lower part of half carcass by razrub on the line passing directly under backbone;

(e) "breast cut" in subsubline items 0203 19 150, 0203 29 150, 0210 12 110 0 and 0210 12 190 0 - the lower part of half carcass located between back gammon and front gammon usually known under the name "streak" (chest part of bacon half), with bones or without bones, but with skin and subcutaneous fat;

(g) "bacon half" in subsubline item 0210 19 100 0 - brainless pork half carcass, jowls, tanks, legs, tail, renal fat, kidneys, cutting, scapular bone, breast, backbone, pelvic bone and diaphragm;

(h) "spenser" in subsubline item 0210 19 100 0 - the bacon half without gammon rolled or not rolled;

(i) "3/4 pork sides" in subsubline item 0210 19 200 0 - the bacon half without first line rolled or not rolled;

(j) "pork core" in subsubline item 0210 19 200 0 - the bacon half without gammon and first line rolled or not rolled.

This subsubline item includes also juncture of pork core, the containing fabrics of brisket and breast cut is pro rata to their natural content in pork core in general.

(B) of the Part of junctures, specified in Item 2 (A) (e), get to the same subsubline items only if they contain skin and subcutaneous fat.

If juncture, getting to subsubline items 0210 11 110 0, 0210 11 190 0, 0210 11 310 0, 0210 11 390 0, 0210 19 300 0 and 0210 19 600 0, are received from bacon half from which the bones called in Item 2 (And) (zh) are already removed, then lines of cutting shall pass respectively across the lines specified in Item 2 (A) (in, d); anyway these juncture or their part shall contain bones.

(C) Podsubpozition 0206 49 000 and 0210 99 490 0 shall include, in particular, the heads or half of the heads of domestic pigs with remote or unextracted brain, cheek or language and their parts.

The head separates from other part of half carcass as follows:

- direct juncture parallel to skull; or

- juncture parallel to skull to the level of eyes and further obliquely to front part so that to leave jowl, attached to half carcass.

Cheeks, pork patches and ears, and also pulp, adjacent to the head, mainly from the back belong to parts of the head. However the boneless meat of first line provided by one juncture (jowls, tanks or jowls and tanks together) gets to subsubline item 0203 19 550, 0203 29 550, 0210 19 500 0 or 0210 19 810 0 depending on specific conditions.

() "Subcutaneous pork fat" in subsubline items 0209 10 110 0 and 0209 10 190 0 means accumulating under skin of animal and the related fatty tissues, irrespective of part of ink from which it is received; anyway the mass of fatty tissues shall exceed the mass of skin.

These subsubline items include also subcutaneous pork fat separated skin.

(E) In subsubline items 0210 11 310 0, 0210 11 390 0, 0210 12 190 0 and 0210 19 600 0 - 0210 19 890 0 products, at which in meat the relation of waters/squirrels equally or less 2,8 (protein = content of nitrogen x 6,25), are considered as "dried or smoked".

3. (A) The following terms used in goods item 0204, mean:

(a) the "flourishes" included in subline items of the 0204th in 10, the 0204th 21, the 0204th 30, 0204 41 and subsubline items 0204 50 110 0 and 0204 50 510 0 - the whole flourishes of the slaughtered animals after bleeding, nutrovka and the removals of skin imported with-headed or brainless with legs or without legs, with other not separated offal or without them. If hulks are imported brainless, then the last shall be separated ink in atlantozatylochny joint. When importing hulks without legs the last shall be chopped off in the field of carpal and metacarpal or joint tarsus-plusnevogo;

(b) "half carcasses" in subline items of the 0204th 10, the 0204th 21, the 0204th 30, 0204 41 and subsubline items 0204 50 110 0 and 0204 50 510 0 - the product which is turning out as a result of symmetric razrub of the whole ink on the center of everyone cervical, chest, lumbar and sacral vertebrae and on the center of breast and sciatic and pubic union;

(c) "front quarter timbers of short razrub" in subsubline items 0204 22 100 0, 0204 42 100 0, 0204 50 130 0 and 0204 50 530 0 - front part of ink, with breast cut or without breast cut, with all bones and shovels, together with hough, neck and cervical and back part, chopped off at right angle to backbone and containing al least five and at most seven pairs of whole or split edges;

() "front quarter timber of short razrub" in subsubline items 0204 22 100 0, 0204 42 100 0, 0204 50 130 0 and 0204 50 530 0 - front part of half carcass, with breast cut or without breast cut, with all bones and shovel, together with hough, neck and cervical and back part, chopped off at right angle to backbone and containing al least five and at most seven whole or split edges;

(e) "chines of back part and/or kidney parts" in subsubline items 0204 22 300 0, 0204 42 300 0, 0204 50 150 0 and 0204 50 550 0 - the ink rest after removal of coxofemoral parts with shank and short front quarter timbers with kidneys or without kidneys; under department from kidney parts chines of back part shall have al least five lumbar vertebrae; kidney parts after department from chines shall have al least five pairs of whole or split edges;

(e) "the chine of back part and/or kidney part" in subsubline items 0204 22 300 0, 0204 42 300 0, 0204 50 150 0 and 0204 50 550 0 - the half carcass rest after removal of coxofemoral part with shank and short front quarter timbers with kidney or without kidney; under department from kidney part the chine of back part shall have al least five lumbar vertebrae; kidney part after department from the chine shall have al least five whole or split edges;
