This Law determines legal and organizational basis of activities of the Investigative Committee of the Republic of Belarus (further if other is not determined, – the Investigative Committee), its main objectives and powers, and also powers, guarantees of legal and social protection of his employees.
The Investigative Committee – the single centralized system including the state law enforcement agencies which are bodies of pretrial investigation and performing powers in the field of pre-judicial criminal proceedings and organization of education.
The Investigative Committee is paramilitary organization, has official heraldic symbols.
The Investigative Committee submits to the President of the Republic of Belarus.
The organizations providing activities of the Investigative Committee can be under supervision of the Investigative Committee.
The legal basis of activities of the Investigative Committee are the Constitution of the Republic of Belarus, this Law, legal acts of the President of the Republic of Belarus, the criminal procedure legislation, other acts of the legislation and the international agreements of the Republic of Belarus.
If the international treaty of the Republic of Belarus establishes other rules, than those which are provided by this Law are applied rules of the international treaty of the Republic of Belarus.
Activities of the Investigative Committee are performed on the principles:
legality;
openness and publicity in that measure in what it does not contradict requirements of the legislation on protection of the rights and legitimate interests of citizens of the Republic of Belarus, foreign citizens and stateless persons (further if other is not determined, – citizens), about the state secrets, the mystery of pretrial investigation and other secret protected by legal acts;
unities of system of the Investigative Committee and centralization of management;
independence when implementing the powers of activities of other state bodies, political parties, other public associations and other organizations.
The main objectives of the Investigative Committee are:
comprehensive, complete, objective and operational investigation of crimes according to the competence established by the criminal procedure legislation;
protection of the rights and legitimate interests of citizens, the organizations, protection of the state and public concerns, respecting the rule of law in case of verification of statements and messages on crimes, initiation of legal proceedings, production of pretrial investigation;
enhancement of investigative work, implementation in practice of achievements of science and technology, positive experience, progressive forms and methods of the organization of pretrial investigation;
identification of the violations of the law, the reasons and conditions promoting making of crimes, taking measures to their elimination;
participation in limits of the competence of realization of the state criminal policy, development of suggestions for improvement of legal regulation in the field of law-enforcement activities;
implementation within the competence of international cooperation in the field of pre-judicial criminal proceedings.
The Investigative Committee performs the activities in interaction with other state bodies and other organizations, including law enforcement agencies and other organizations of foreign states, the international organizations, and citizens according to legal acts and international treaties of the Republic of Belarus.
State bodies, other organizations and their officials within the competence shall render assistance to the Investigative Committee in accomplishment of the tasks assigned to it.
Citizens can voluntarily render assistance to the Investigative Committee in accomplishment of the tasks assigned to it.
The system of the Investigative Committee is constituted:
central office of the Investigative Committee;
managements of the Investigative Committee on areas and Minsk;
district (interdistrict), city, district departments of the Investigative Committee in the cities;
organization of formation of the Investigative Committee.
The central office of the Investigative Committee heads system of the Investigative Committee and exercises within the powers regulation and control in the field of pretrial investigation.
The structure of central office of the Investigative Committee includes head departments, managements, departments, sectors (groups) and other divisions.
The central office of the Investigative Committee is legal entity, has seal and forms with the image of the State Emblem of the Republic of Belarus and with the name.
