About approval of the Instruction about the organization of production, release into the stream of commerce and realization of commemorative and investment coins of Ukraine, souvenirs

According to Articles 7, 33 and 42 Laws of Ukraine "About the National Bank of Ukraine" and for the purpose of normative settlement of procedure for the organization of production, release into the stream of commerce and realization of commemorative and investment coins of Ukraine, souvenirs of Board of the National Bank of Ukraine DECIDES:

1. Approve the Instruction about the organization of production, release into the stream of commerce and realization of commemorative and investment coins of Ukraine, souvenirs which is applied.

2. Recognize invalid:

Item 1.3 of the resolution of Board of the National Bank of Ukraine of 14.06.2005 No. 211 "About approval of Changes in some regulatory legal acts of the National Bank of Ukraine", registered in the Ministry of Justice of Ukraine 01.07.2005 for No. 704/10984;

the resolution of Board of the National Bank of Ukraine of 14.05.2007 No. 172 "About approval of Changes in the Instruction about the organization of production, release into the stream of commerce and realization of commemorative coins of Ukraine and souvenirs", registered in the Ministry of Justice of Ukraine 04.06.2007 for No. 579/13846;

the resolution of Board of the National Bank of Ukraine of 17.01.2008 No. 11 "About approval of Changes in the Instruction about the organization of production, release into the stream of commerce and realization of commemorative coins of Ukraine and souvenirs", registered in the Ministry of Justice of Ukraine 01.02.2008 for No. 80/14771;

the resolution of Board of the National Bank of Ukraine of 07.03.2008 No. 58 "About approval of Changes in the Instruction about the organization of production, release into the stream of commerce and realization of commemorative coins of Ukraine and souvenirs", registered in the Ministry of Justice of Ukraine 20.03.2008 for No. 234/14925;

the resolution of Board of the National Bank of Ukraine of 10.09.2008 No. 276 "About approval of Changes in the Instruction about the organization of production, release into the stream of commerce and realization of commemorative coins of Ukraine and souvenirs", registered in the Ministry of Justice of Ukraine 01.10.2008 for No. 920/15611.

3. To general department of regulation of money turnover (Nesterenko V. M.) after state registration in the Ministry of Justice of Ukraine to bring contents of this resolution to the attention of territorial administrations of the National Bank of Ukraine and structural units for use in work.

4. To impose control over the implementation of this resolution on the vice-chairman of the National Bank of Ukraine Rychakovskaya V. I.

5. The resolution becomes effective from the date of its official publication.

The instruction about the organization of production, release into the stream of commerce and realization of commemorative and investment coins of Ukraine, souvenirs

1. General provisions

1.1. This Instruction is developed according to the Law of Ukraine "About the National Bank of Ukraine" and to the Presidential decree of Ukraine of 28.09.2004 No. 1142 "About exclusive right of the National Bank of Ukraine" according to which the National Bank of Ukraine (further - National Bank) is granted exclusive right on production of commemorative and investment coins which are legal means of payment in the territory of Ukraine, and establishes procedure for planning, the organization of production, release into the stream of commerce of realization and purchase of these coins, and also souvenirs, and in connection with use for their production of precious and non-noble metals, and also can be implemented by use of special technologies of stamping and decorating at the prices which differ from their nominal value.

1.2. In this Instruction terms are used in such value:

auction for sale of commemorative coins of Ukraine and souvenirs (further auction) - sale of commemorative coins of Ukraine and souvenirs as a result of which their owner is that participant (legal entity or physical person) who during tendering offered the highest price;

the distributor of National Bank (further - the distributor) - bank of Ukraine, other legal entity determined by National Bank which based on contracts with National Bank sell on its own behalf numismatical products of National Bank and investment coins provide development and strategy implementation on expansion of the markets of their sale and promotion;

investment coins of Ukraine (further - investment coins) - the coins made of precious metals with tests for gold - 999,9, for silver - 999,9, for platinum - 999,5, which are intended for investment and accumulating;

quality category of stamping of commemorative and investment coins - the characteristic of physical (external) condition of commemorative and investment coins ("proof", "pruflayk", "diamond-antsirkuleyted", "special antsirkuleyted", "antsirkuleyted") which is reached by means of use of special technologies of stamping. Quality categories of stamping of commemorative and investment coins are specified in appendix 1 to this Instruction;

numismatical products of National Bank - commemorative coins of Ukraine from precious and non-noble metals, commemorative banknotes, souvenirs from non-noble metals [product with use of change and turnover coins or banknotes of national currency of Ukraine, including in souvenir packaging, uncut sheets of banknotes, and also products which do not contain coins or banknotes of national currency and do not perform function of instrument of payment (medals, souvenir coins and banknotes and t. o)], souvenirs from precious metals [products from precious metals which do not contain coins or banknotes of national currency and do not perform function of instrument of payment (the souvenir silver hryvnias, souvenir products imitating banknotes, medals and so forth)], souvenir coins;

wholesale price of National Bank (further - wholesale price) - the price at which the National Bank sells commemorative coins and souvenirs to distributors in lots;

commemorative banknotes - the banknotes of national currency of Ukraine issued by special circulation to significant events and anniversaries which celebration is celebrated at the national level, including banknotes of the operating nominal row with drawing additional elements of design, etc.

commemorative coins of Ukraine (further - commemorative coins) - coins from precious or non-noble metals which are made using the special technologies providing the increased quality of coins and are released by National Bank limited circulations on the occasion of celebration of anniversaries, memorable events of history and the present, actions for protection of the surrounding environment, other events of public life;

the damaged commemorative and investment coins, the souvenirs found in storages of National Bank - commemorative and investment coins, souvenirs which in the course of storage in cash inventories the Operations department and department of currency circulation in regions of National Bank and/or reserve funds of the Central storage acquired damage signs (change of color of surface, spot, corrosion, etc.) or the hidden defect of the producer was found;

the damaged investment coins acquired at physical persons - the investment coins having damage signs [deformation, pollution, impact of fire, highly active substances and environments, corrosion, signs of mechanical impact (openings, breaks, scratches), etc.] cannot be also used as instrument of payment for calculations for all types of cash transactions;

retail price of National Bank (further - retail price) - the price according to which the Operations department and department of currency circulation in regions in regions of National Bank are implemented commemorative coins and souvenirs separately to physical persons and legal entities;
