1. Approve the enclosed Rules of the organization and functioning of the wholesale market of electrical energy of the Republic of Kazakhstan.

2. This resolution becomes effective after ten calendar days after the first official publication.

Rules of the organization and functioning of the wholesale market of electrical energy of the Republic of Kazakhstan

1. General provisions

1. These rules of the organization and functioning of the wholesale market of electrical energy of the Republic of Kazakhstan (further - Rules) are developed according to the Law of the Republic of Kazakhstan of July 9, 2004 "About power industry" (further - the Law) and determine procedure for the organization and functioning of the wholesale market of electrical energy in the territory of the Republic of Kazakhstan.

2. In Rules the following concepts and determinations are used:

1) system operator - the organization exercising centralized operativnodispetchersky control, ensuring parallel work with power supply systems of other states, maintenance of balance in power supply system, rendering system services and acquisition of support services at subjects of the wholesale market of electrical energy and also transfer of electrical energy on national power grid, its maintenance and maintenance in operational readiness;

2) the actual balance of production consumption of electrical energy in the wholesale market of electrical energy of the Republic of Kazakhstan - the document constituted by the system operator establishing address distribution of amounts of the made, delivered and consumed electrical energy in the markets of the decentralized and centralized trade, the balancing market of electrical energy for settlement period. The actual balance is the basis for carrying out settlement between subjects of the wholesale market of electrical energy of the Republic of Kazakhstan;

3) authorized body - the state body performing management in the field of power industry;

4) regulation of electric power - service in compensation of variations of the actual electric load of the subject of the wholesale market of electrical energy from the declared electric loading on condition of respect for zero balance of exchange electrical energy, with planning or without planning in the daily schedule;

5) transfer of electrical energy - the service rendered by the power transferring organizations according to the signed agreements of transfer of electrical energy;

6) the subjects of the wholesale market of electrical energy which - are power making, power transferring, power supplying the organizations, consumers of electrical energy, the system operator, the operator of the market of centralized trade with electrical energy;

7) the operator of the market of centralized trade by electrical energy - the organization performing the centralized biddings by electrical energy including spot biddings of electrical energy;

8) the market of centralized trade by electrical energy - organized trading floor for sale and purchase of electrical energy on short-term (spot biddings "within operational days" and in the mode "in day ahead"), medium-term (week, month) and long-term (quarter, year) the basis;

9) the purchase and sale agreement of electrical energy - the agreement signed between subjects of the wholesale market of electrical energy for purchase/sale of contractual amounts of electrical energy with their physical delivery to certain period;

10) transit of electrical energy - service in use of power networks of one or several adjacent countries for transfer of electrical energy from power supply system of other country;

11) the wholesale market of electrical energy - the system of the relations connected with purchase and sale of electrical energy, functioning on the basis of agreements between subjects of the wholesale market of electrical energy.

3. The wholesale market of electrical energy in the Republic of Kazakhstan represents the system of the relations connected with purchase and sale of electrical energy, functioning on the basis of agreements between subjects of the wholesale market of electrical energy and consists from is interconnected the operating markets:

1) the market of the decentralized purchase and sale of electrical energy;

2) market of centralized trade by electrical energy;

3) the balancing market of electrical energy;

4) market of system and support services.

2. Procedure for the organization and functioning of the wholesale market of electrical energy

4. For participation in the wholesale market of electrical energy subjects of the wholesale market of electrical energy in case of accomplishment of compliance conditions are allowed by them based on which they get access to national power grid.

5. The power making organizations participate in the wholesale market of electrical energy in case of accomplishment of the following conditions:

1) license availability according to the procedure, stipulated by the legislation in the field of licensing of the Republic of Kazakhstan;

2) delivery to the wholesale market of electrical energy of at least 1 megawatts (daleemvt) average daily (basic) capacity (for renewable energy resources of annual average capacity) and availability of the automated systems of commercial accounting, telecommunications providing their unification with the systems installed at the system operator;

3) access availability to national and in need of regional power network.

6. Access to national power grid and/or to regional power network is provided to the power making organizations in the presence of agreements with the system operator:

1) on rendering services in technical scheduling of the modes of production/consumption of electrical energy in single electric utility system of Kazakhstan;

2) on rendering services in the organization of balancing of production/consumption of electrical energy in single electric utility system of Kazakhstan;

3) for purchase/sale of the balancing electrical energy.

7. The consumers of electrical energy including who are power giving the organizations participate in the wholesale market in case of accomplishment of the following conditions:
