About public and private partnership for rendering services of radiotheraphy

(as amended on 19-12-2018)

Based on Items and), b) and e) article 11 of the Law No. 179-XVI of July 10, 2008 on public and private partnership (The official monitor of the Republic of Moldova, 2008, Art. No. 165-166, 605), with subsequent changes and amendments, and according to provisions of the Law on health care No. 411-XIII of March 28, 1995 (The official monitor of the Republic of Moldova, 1995, No. 34, the Art. 373), with subsequent changes and amendments, DECIDES: the Government

1. Offer as the project of public and private partnership of service of radiotheraphy in the field of oncology, including the rooms intended for their rendering in the public medical and sanitary organization of Institute of oncology located on Ulitsa Nicolae Testemitsan, 30, mun. Chisinau.

2. Approve the purposes and conditions of public and private partnership for rendering services in the field of radiotheraphy in public medical and sanitary organization Institute of oncology, and also the main requirements to the choice of the private partner (are attached).

3. Appoint the Ministry of Health, work and social protection as responsible state body on holding procedure of the choice of the private partner and the conclusion of the contract with it.

4. National medical insurance company for the purpose of ensuring implementation of public and private partnership to sign annually the contract with the private partner chosen in accordance with the established procedure for rendering medical services within compulsory medical insurance.

4-1. To the Ministry of Health, work and social protection to provide to the Ministry of Finance and the National company of medical insurance in the greatest possible measure:

1) budgeting of general annual payment, owed to the private partner according to the agreement on public and private partnership, in case of development of the annual law on funds of compulsory medical insurance;

2) budgeting of financing of fee of the Ministry of Health, work and social protection in covering of general payment, owed to the private partner, according to the agreement on public and private partnership, in case of development of the annual law on the government budget.

 4-2. To the Ministry of Health, work and social protection in the shortest possible time to notify Competition council on creation of the project of public and private partnership for rendering services of radiotheraphy according to the Law No. 139 of June 15, 2012 on government assistance, and to the bodies specified in Item 5, to start implementation of the project only after decision of Competition council by which it is stated that the notified measure is not government assistance or as necessary, decisions on permission of government assistance, with conditions or without conditions, only if the conditions or obligations provided in the decision of Competition council can be executed by the Ministry of Health, work and social protection, other relevant bodies and organizations, and also the private partner.

4-3. The government will not initiate other projects is private the state partnership in the field of radiological services during the term of the agreement about is private the state partnership, the appendix to this resolution provided in Item 9.

5. To impose control over the implementation of this resolution on the Ministry of Health, work and social protection, the Ministry of Finance, the Ministry of Economics by means of the Agency of state-owned property and the National company of medical insurance, within functional competences.

Purposes and conditions of the project of public and private partnership for rendering services of radiotheraphy in public medical and sanitary organization Institute of oncology, and also main requirements to the choice of the private partner

Section 1. Purposes of public and private partnership

1. Main objectives of public and private partnership on rendering services of radiotheraphy in public medical and sanitary organization Institute of oncology (further - Institute of oncology) are:

1) upgrade of services of radiotheraphy by attraction of private investments and reducing budgeted expenses on these purposes;

2) improvement of quality of services of radiotheraphy and ensuring need of the population for services of radiotheraphy at the national level due to simplification of access to high-quality services of radiotheraphy;

3) increase in efficiency of use of state-owned property and money for medical services.

2. The specific purpose are repair and/or construction, equipping, financing and operation of service of radiotheraphy at Institute of oncology. In particular this purpose provides:

1) financing, delivery, acceptance in operation if it is necessary, and servicing of the medical equipment of radiotheraphy necessary at Institute of oncology for service of radiotheraphy;

2) financing of designing, construction and upgrade of premises of Institute of oncology where the medical equipment for rendering services of radiotheraphy, with use of the advanced information system of management of planning of treatment and application of medical procedures will be placed;

3) long operation of the center of radiotheraphy, including providing with necessary personnel for rendering all services of radiotheraphy and maintenance of the center and the equipment;

4) observance of the high quality standards and practice in the field of radiotheraphy, similar to the advanced international practice, including ensuring radiation protection of the patients and persons subject to professional impact of ionizing radiation, and submission of the corresponding reports on all applied procedures in the field of radiotheraphy.

Section 2. Main requirements to the choice of the private partner

3. The procedure of the choice of the private partner is carried out by means of open one-stage tender within which the interested offerers shall provide technical and financial offers. Evaluation criteria shall be provided in standard documentation.

4. The offerer can be person of the legal right, physical person or represent consolidation of these persons.
