About adoption of the technical regulation of the Customs union "About safety of separate types of specialized food products, including dietary clinical and dietary preventive foods"
According to article 3 of the Agreement on the Eurasian economic commission of November 18, 2011 Council of the Eurasian economic commission solved:
1. Accept the technical regulation of the Customs union "About safety of separate types of specialized food products, including dietary clinical and dietary preventive foods" (TR CU 027/2012) (is applied).
2. Determine that the technical regulation of the Customs union specified in Item 1 of this Decision becomes effective since July 1, 2013.
3. This Decision shall enter into force upon the expiry of 30 calendar days from the date of its official publication.

Preface
1. This technical regulation of the Customs union "About safety of separate types of specialized food products, including dietary clinical and dietary preventive foods" (further - the Technical regulation) is developed according to the Agreement on the single principles and rules of technical regulation in the Republic of Belarus, the Republic of Kazakhstan and the Russian Federation of November 18, 2010.
2. This Technical regulation is developed for the purpose of establishment on single customs area of the Customs union single obligatory for application and execution of requirements to separate types of the specialized food products, including dietary clinical and dietary preventive foods, ensuring free movement released on single customs area of the Customs union.
3. If concerning separate types of specialized food products, including dietary clinical and dietary preventive foods other technical regulations of the Customs union establishing requirements to it, then separate types of specialized food products are accepted, including dietary clinical and dietary preventive foods shall conform to requirements of all technical regulations of the Customs union which action extends to them.
1. This Technical regulation establishes:
1) objects of technical regulation;
2) safety requirements (including sanitary and epidemiologic and hygienic requirements) to objects of technical regulation;
3) rules of identification of objects of technical regulation;
4) forms and rules of assessment of conformity of objects of technical regulation to requirements of this Technical regulation.
2. The purposes of adoption of this Technical regulation are:
protection of life and (or) health of the person;
the prevention of actions, the misleading acquirers (consumers).
3. In case of application of this Technical regulation the requirements to food products regarding its marking, to the materials contacting to food products, including packaging, and the used food staples established by the corresponding technical regulations of the Customs union shall be considered.
4. In case of application of this Technical regulation requirements of the technical regulations of the Customs union establishing mandatory requirements to food products and its separate types shall be considered.
1. Objects of technical regulation of this Technical regulation are released and being in circulation on single customs area of state members of the Customs union:
specialized food products for food of athletes, pregnant women and the feeding women;
food products of dietary clinical and dietary preventive foods, including for baby food.
2. Requirements of this Technical regulation do not extend on:
food products for baby food, except for food products for dietary clinical and dietary preventive foods for baby food;
the food products made by the companies of food (public catering, in organized collectives);
mineral natural, medical and table, medicinal mineral water with mineralization over 1 mg/dm3 or in case of smaller mineralization, the containing biologically active components in quantity not below balneological regulations;
dietary supplements to food.
1. For the purposes of reference of separate types of specialized food products, including dietary clinical and dietary preventive foods, to objects of technical regulation to which this Technical regulation is applied interested persons perform identification of food products.
2. Identification of separate types of specialized food products, including dietary clinical and dietary preventive foods, is carried out according to the procedure, established by the technical regulation of the Customs union "About safety of food products".
In this Technical regulation the determinations established by the technical regulation of the Customs union "About safety of food products" and also the following terms and determinations are used:
1) food products of dietary clinical nutrition - specialized food products with the set nutrition and energy value, physical and organoleptic properties, and held for use as a part of medical diets;
2) food products of dietary preventive foods - the specialized food products intended for correction carbohydrate, fatty, proteinaceous vitamin and other types of metabolism in which content and (or) ratio of separate substances of their rather natural content is changed and (or) the list of whom includes not the substances or components which are present initially, and also the food products intended for decrease in risk of development of diseases;
3) food products for food of athletes - the specialized food products of the set chemical composition, the increased nutrition value and (or) directed efficiency consisting of complex of products or provided by their separate types which exert specific impact on increase in adaptive opportunities of the person to physical and neuroemotional activities;
