RESOLUTION OF THE CABINET OF MINISTERS OF THE REPUBLIC OF UZBEKISTAN

of June 13, 2012 No. 171

About approval of the Regulations on Children's homes

(as amended on 07-07-2020)

In pursuance of the resolution of the President of the Republic of Uzbekistan of February 27, 2012 No. PP-1717 "About the State program "Year of family", for the purpose of enhancement of activities of Children's homes, strengthening of legal protection and increase in efficiency of measures for providing medico-social guarantees, creations of necessary conditions for education, education, integration into society of orphan children and children without parental support, children with violations of psychophysical development the Cabinet of Ministers decides:

1. Approve Regulations on Children's homes according to appendix.

2. To the Ministry of Health of the Republic of Uzbekistan together with the Ministry of Labour and Social Protection of the population and the Ministry of Finance of the Republic of Uzbekistan to review the existing regular standard rates of Children's homes in a month, having provided in them personnel for work on social legal protection of children pupils, and also reduction of the operating settlement regulations of loading of pedagogical and junior service personnel.

Determine that additional expenses of the budget in connection with increase in the specified personnel of Children's homes are covered due to optimization of network and bed fund of healthcare institutions.

3. It is regular to ministry of national education of the Republic of Uzbekistan to perform actions for preparation, retraining and advanced training of teachers and tutors taking into account modern technologies of education, education, psychological and intellectual development of children - pupils of Children's homes.

4. To the Ministry of Health of the Republic of Uzbekistan:

together with Council of Ministers of the Republic of Karakalpakstan, khokimiyats of areas and Tashkent to take measures for further strengthening of material and technical resources of Children's homes and creation in them necessary conditions for assistance to children pupils, and also to provide systematic control of activities of Children's homes, to render them every possible assistance in implementation of the tasks assigned to them;

together with the interested ministries and departments to make offers in the Cabinet of Ministers on changes in the legislation in a month, and also to bring departmental regulatory legal acts into accord with this resolution.

5. To impose control of execution of this resolution on the deputy prime minister of the Republic of Uzbekistan A. N. Aripov.

Regulations on Children's homes

I. General provisions

1. This Provision determines procedure for creation and activities of Children's homes of system of the Ministry of Health of the Republic of Uzbekistan, and also the organization in them the public, psychology and pedagogical assistance and educational and educational process to orphan children, children without parental support, and also children with violations of psychophysical development.

2. The children's home is the public educational and educational and medical and improving institution for orphan children, children without parental support, and also children with violations of psychophysical development (further - pupils).

3. The children's home in the activities is guided by the Constitution and the laws of the Republic of Uzbekistan, resolutions of chambers of Oliy Majlis of the Republic of Uzbekistan, decrees, resolutions and orders of the President of the Republic of Uzbekistan, resolutions and orders of the Cabinet of Ministers of the Republic of Uzbekistan, other acts of the legislation, international treaties of the Republic of Uzbekistan, and also this Provision and the Charter.

4. The children's home has the right to perform international cooperation concerning enhancement of medico-social and psychology and pedagogical activities according to the legislation.

5. The children's home can be created, reorganized or liquidated in accordance with the established procedure by the Ministry of Health of the Republic of Uzbekistan in coordination with Council of Ministers of the Republic of Karakalpakstan, khokimiyats of areas and the city of Tashkent. In case of liquidation of Children's home transfer of pupils to other relevant organizations is provided.

6. The children's home is created in the form of public institution and is registered as the legal entity in khokimiyat of the respective area, has the charter, separate balance, personal account in the relevant territorial subdivision of treasury and the currency account in bank, seal with the image of the State Emblem of the Republic of Uzbekistan and with indication of the name, stamp, forms.

7. The charter of Children's home affirms the Ministry of Health of the Republic of Karakalpakstan, managements of health care of areas and head department of health care of Tashkent based on the standard charter approved by the Ministry of Health of the Republic of Uzbekistan.

8. Ceased to be valid according to the Resolution of the Cabinet of Ministers of the Republic of Uzbekistan of 07.07.2020 No. 429

9. The type of Children's home and quantity of beds are established by the Ministry of Health of the Republic of Uzbekistan. Children's homes function round the clock.

10. Coordination of activities of Children's homes is performed by the Ministry of Health of the Republic of Karakalpakstan, managements of health care of areas and Head department of health care of Tashkent.

II. Main objectives of Children's homes

11. The main objectives of Children's homes are:

ensuring medical care, education and education, development and support of pupils;

creation of the conditions as close as possible to house, the promoting full psychological recovery, social adaptation and integration of pupils into society;

providing social legal protection of the rights and legitimate interests of pupils;

ensuring psychological, intellectual and physical development of pupils;

the organization of the medical and improving work including carrying out medical examination, prevention, treatment and improvement of pupils, correctional and recovery actions for children with violations of psychophysical development, medico-psychology and pedagogical rehabilitation of pupils;

enhancement of the forms and methods of work directed to improvement of quality medical and improving educational and educational and if necessary, the correctional developing process;
