About approval of the Procedure for carrying out inventory count of lands

(as amended on 22-11-2017)

According to Item 7 of the Section VII "Final and transitional provisions" of the Law of Ukraine "About the State land cadastre" the Cabinet of Ministers of Ukraine decides:

Approve the Procedure for carrying out inventory count of lands which is applied.

Procedure for carrying out inventory count of lands

1. This Procedure establishes requirements to carrying out inventory count of lands during implementation of land management and creation by its results of technical documentation on land management concerning carrying out inventory count of lands (technical documentation is farther).

2. Inventory count of lands is carried out on purpose:

ensuring maintaining the State land cadastre, control of use and protection of lands;

determinations of high-quality condition of the parcels of land, their borders, size, structure of grounds;

approvals of the data obtained as a result of carrying out inventory count of lands with information containing in documents which certify the right to the parcel of land, and in the State land cadastre;

acceptances by results of inventory count of lands by the Cabinet of Ministers of Ukraine, Council of Ministers of the Autonomous Republic of Crimea, the local state administrations and local government bodies of relevant decisions;

land management implementation.

3. Inventory count of lands is carried out proceeding from the principles of planned character, reliability and completeness of data, the sequence and commonality of the procedures this to availability of use of information base, generalization with respect for the single principles and technologies of their processing.

4. Objects of inventory count of lands according to this Procedure are the territory of Ukraine, the territory of administrative and territorial units or their parts, the separate parcels of land.

5. Inventory count of lands is carried out within administrative and territorial units, land ownership or land use and the territories which borders are determined by projects of forming of the territory and establishment of borders of village, settlement councils.

6. No. 890 is excluded according to the Resolution of the Cabinet of Ministers of Ukraine of 22.11.2017.

7. Basic data for carrying out inventory count of lands are:

materials from the State fund of documentation on land management;

data from the State land cadastre in paper and electronic form, including the Land book; blotters of registration of the state acts for the property right to the earth and on the right of permanent use of the earth, land lease agreements; files of data exchange about results of works on land management;

the town-planning documentation approved in the procedure established by the legislation;

planned cartographic materials, including the orthophotomaps constituted by results of performance of works according to the Loan agreement ("Issue of the State Acts on the Property Right to the Earth in the Rural Zone and Development of System of the Inventory" project) between Ukraine and the International Bank for Reconstruction and Development;

data from the State register of the corporeal rights to real estate and their restrictions;

copies of documents which certify the right to the parcel of land or confirm payment of the land tax;

the materials prepared by results of inspection of the parcels of land concerning their high-quality condition;

during inventory count of lands materials of aerial photography, forest management, projects of creation of the territories and objects of natural reserved fund, the scheme of forming of econetwork, the program in the field of forming, preserving and use of econetwork are used.

8. The basis for carrying out inventory count of lands is the decision of relevant organ of the executive authority, Council of Ministers of the Autonomous Republic of Crimea or local government body concerning accomplishment of the corresponding works, the agreements signed between legal entities or physical persons (land owners and land users) and developers of documentation on land management, judgments.

9. Executive bodies, Council of Ministers of the Autonomous Republic of Crimea or local government bodies, land owners and land users (further - customers) can be customers of technical documentation.

10. Developers of technical documentation (further - the contractor) are:

the legal entities having necessary technical and technological support and as a part of which at least two certified engineers land surveyors who are responsible for quality of works on land management work on principle place of employment;

physical persons entrepreneurs who have necessary technical and technological support and are the certified engineers - the land surveyors responsible for quality of works on land management.

11. For carrying out inventory count of lands the customer signs with the contractor the agreement on development of technical documentation in which the cost and term of performance of works on land management which shall not exceed six months from the moment of the conclusion of the agreement are displayed.

The specification on performance of works on inventory count of lands in form according to appendix and their estimate is attached to the agreement.

12. Works on inventory count of lands include preparatory, land and cameral work, creation and execution of technical documentation in paper and electronic form.

13. Preparatory work includes collection and the analysis by the contractor of basic data for carrying out inventory count of lands, creation of the working inventory plan.

The working inventory plan is not constituted in case of inventory count of the separate parcel of land.

14. The working inventory plan is constituted on the basis of the cadastral plan on duty or other planned cartographic materials within the cities and settlements - in scale not more small 1: 5000, within rural settlements - in scale not more small 1: 2000, within the territories determined by projects of forming of the territory and establishment of limits of village, settlement councils - in scale not more small 1: 10000, within areas - in scale 1: 25000, with indication of borders:

object of inventory count;

administrative and territorial units which were part of object of inventory count;

the territories determined by projects of forming of the territory and establishment of borders of village, settlement councils;

lands of all patterns of ownership;

the parcels of land which are brought in the State land cadastre;

restrictions (burdenings) in use of the parcels of land;

grounds.
