THE RESOLUTION OF BOARD OF SOCIAL INSURANCE FUND ON TEMPORARY DISABILITY OF UKRAINE

About approval of the Procedure for provision of material security by fund of social insurance on temporary disability to insured persons in case of liquidation (reorganization) of the company, organization, the organization, the termination of business activity of the physical person - the entrepreneur who has hired employees

According to Article 11, the paragraph the second "About obligatory national social insurance in connection with the temporary disability and expenses caused by burial" the board of Social Insurance Fund from temporary loss of working capacity DECIDES: parts one of article 50 of the Law of Ukraine

1. Approve the Procedure for provision of material security by fund of social insurance on temporary disability to insured persons in case of liquidation (reorganization) of the company, organization, the organization, the termination of business activity of the physical person - the entrepreneur who has hired employees.

2. To submit to executive directorate of Social Insurance Fund on temporary disability this resolution on state registration to the Ministry of Justice of Ukraine.

3. This resolution becomes effective from the date of its official publication.

1. This Procedure determines conditions of provision by Social Insurance Fund on temporary disability (farther Fund) material security to insured persons in case of liquidation (reorganization) of the company, organization, the organization, the termination of business activity of physical litsapredprinimatel who has hired employees, and absence of the legal successor on insured events which came before their liquidation (reorganization), during work of insured persons according to the paragraph the second parts one of article 50 of the Law of Ukraine "About obligatory national social insurance in connection with the temporary disability and expenses caused by burial" by types of material security:

the help with temporary disability (including care of the sick child);

help with pregnancy and childbirth;

the help on burial (except burial of pensioners, unemployed and persons who died of labor accident).

2. Appointment and payment to insured persons (or to receivers of the help) material security are performed by district, interdistrict, city executive directorates of departments of Fund (further - working bodies of Fund) in the place of accounting of liquidated enterprise, organization, organization or termination of business activity physical persons entrepreneurs which has hired employees as insurer based on the order of the head of working body of Fund.

3. Bases for purpose of the help:

3.1. The basis for purpose of the help with temporary disability, on pregnancy and childbirth the disability leaf issued in accordance with the established procedure is.

3.2. The help is appointed to burial of insured person to the member of his family or person who performed burial (further - the receiver of the help), based on the death certified by body of state registration of acts of civil status, and excerpt from the State register of acts of civil status of citizens about death for receipt of the help on burial (in case of registration of death by executive body rural, settlement, city sovetaspravka).

3.3. The help is appointed to insured person based on the documents determined in subitem 3.2 of this Item to burial of the family member who was on content of insured person.

3.4. The help on burial of insured person or member of his family is provided to legal entity or physical person which performed burial, based on the documents specified in the subitem

3.2 this Item, and also documents on confirmation of implementation by receivers of the help of such burial.

4. For receipt of material security on temporary disability, on pregnancy and childbirth insured person files to working body of Fund such documents:

the statement in any form of provision of material security with indication of details of bank institution and number of the current account;

disability leaf;

registration number of the accounting card of the taxpayer or series and passport number (for physical persons which because of the religious beliefs refuse adoption of registration number of accounting card of the taxpayer and officially reported about it to relevant organ of the State Tax Service and have mark in the passport);

copy of the service record;

the copy of the first - the fourth, eleventh - the sixteenth pages of the passport;

the reference from archival organization of accrued payroll for the corresponding settlement period (monthly) with indication of payment types and the number of the fulfilled days (hours) certified in accordance with the established procedure;

in case of need for purpose of the help with temporary disability in the amount of hundred percent of the average salary (income) the insured persons specified in paragraph five of part one of article 37 of the Law of Ukraine "About obligatory national social insurance in connection with the temporary disability and expenses caused by burial" attach the copies of the corresponding certificates or other documents confirming the right to privilege;

in case of need for confirmation of insurance years of service of insured person - information on paid amounts of single fee obtained according to the Law of Ukraine "About collection and accounting of single fee on obligatory national social insurance";

in case of need the copy of the certificate of birth of the child (for establishment of age of the child in case of payment of leaf of disability on care of the sick child).

5. For receipt of the help the receiver of the help (or insured person in case of the death of the member of his family) submits for burial to working body of Fund such documents:

the statement in any form of assistance on burial by fund with indication of details of bank institution and number of the current account;

the documents determined in subitems 3. 2, to 3.4 Item 3 of this Procedure;

registration number of the accounting card of the taxpayer or series and passport number (for physical persons which because of the religious beliefs refuse adoption of registration number of accounting card of the taxpayer and officially reported about it to relevant organ of the State Tax Service and have mark in the passport);
