About the prevention and liquidation of emergency situations

This Law regulates the legal basis of the activities connected with the prevention and liquidation extraordinary situations and their effects.

CHAPTER I. General provisions

Article 1. Basic concepts

In this Law the following basic concepts are used:

emergency situation - the situation which developed in certain territory as a result of accident, catastrophic crash and other disaster, including natural and ecological nature which entailed or can entail death of people, do harm to their health or violate conditions of life activity of the population, cause damage to the surrounding environment, objects of production and social infrastructure;

zone of emergency situation - the territory in which it developed emergency (is declared);

the prevention of emergency situations - complex of the events held beforehand and directed to the greatest possible decrease in risk of emergence of emergency situations, and also to preserving human health, reduction of damage to the surrounding environment and material losses in case of their origin;

liquidation of emergency situations - the rescue and other urgent works which are carried out in case of emergency situations, directed to rescuing of life of people, localization of emergency situations and characteristic factors, dangerous to them, reduction of damage to the surrounding environment and material losses;

potentially dangerous objects industrial enterprises, storage bases and other objects, emergence of accident on which threatens life and activities of the working personnel, and also the population living near such objects.

Article 2. The legislation of Turkmenistan according to the prevention and liquidation of emergency situations

The legislation of Turkmenistan according to the prevention and liquidation of emergency situations consists of this Law and other regulatory legal acts of Turkmenistan.

Article 3. Coverage of this Law

Operation of this Law extends to the relations of the physical persons and legal entities which are in the territory of Turkmenistan, arising in the course of their activities for the prevention and liquidation of emergency situations, and also for protection of the population and the territory in case of their origin.

Article 4. Classification of emergency situations

Evaluation criteria and classification of emergency situations, procedure for reference of zone of emergency situation to national, regional, local, object or local are determined by the Cabinet of Ministers of Turkmenistan.

Article 5. Single state system according to the prevention of emergency situations

The organization and procedure for functioning of single state system for the prevention of emergency situations are determined by the President of Turkmenistan. The procedure for information technical supply of state bodies concerning the prevention and liquidation of emergency situations is determined by State commission of Turkmenistan by emergency situations.

Article 6. Financing of actions for the prevention and liquidation of emergency situations

Financing of actions for the prevention of emergency situations is performed by the ministries, departments, the companies, the organizations and organizations at the expense of own means, means of the state funds and local budgets.

Financing of actions for liquidation of emergency situations and their effects is performed at the expense of means of the companies, the organizations and organizations which are in zone of emergency situations, the corresponding local budgets, and also insurance funds. In case of absence or insufficiency of the means specified in parts 1 and 2 of this Article the means from Fund for emergency situations which are annually provided in the Government budget of Turkmenistan are used. Fund on emergency situations is allocated by the President of Turkmenistan on representation to State commission of Turkmenistan on emergency situations.

Article 7. Information on emergency situations

Information on emergency situations is constituted by data on threat of emergence of emergency situations, including radiative, chemical, biological, ecological and other effects on the population and the surrounding environment, the fires and explosions on potentially dangerous objects, and also about the arisen emergency situations and their effects. State governing bodies, the local executive authority and local self-government, heads of the companies, organizations and organizations, irrespective of patterns of ownership, shall inform timely and authentically the population through mass media, communication and warning systems on probability of origin, the arisen emergency situations, on the taken measures for safety, acceptances and methods of protection of the population in case of threat and emergence of emergency situations.

CHAPTER II. Prevention of emergency situations

Article 8. Actions for the prevention of emergency situations

Treat actions for the prevention of emergency situations: the organization and ensuring scientific research, test and project works for problems of radiation, chemical, medicobiological, fire, ecological and other safety, development and implementation of precepts of law and rules on them; implementation of observation of state of environment and forecasting of situation: the organization of the notification about threat of the accidents, disasters and catastrophic crashes promoting emergence of emergency situations; development and implementation of target and scientific and technical programs for the prevention of emergency situations; development and implementation of technical and other actions for increase in stability of functioning of the companies, the organizations and organizations in case of emergency situations; ensuring readiness of governing bodies, relevant services for implementation of actions for the prevention and liquidation of emergency situations; training of the population in actions in case of threat of emergence of emergency situations and to protection methods in case of their origin.

Article 9. Forecasting of emergency situations

Forecasting of emergency situations is performed on the basis of observation of state of environment by the seismological, radiation, ecological and other control services created under authorized state bodies and included in single state system according to the prevention of emergency situations.

Article 10. Protective measures for the purpose of decrease in risk of emergence of emergency situations

For the purpose of the greatest possible decrease in risk of emergence of emergency situations protective measures shall be performed:
