I. General provisions

Subject of regulation of Regulations

1.1. The administrative regulations of the Federal Service for Technical and Export Control on provision of the state service in implementation (within the competence) non-tariff regulation of foreign trade activity, including issue of licenses for implementation of transactions on export and (or) commodity import (works, services), information, results of intellectual activities (the rights to them) in cases, stipulated by the legislation the Russian Federation (further - Regulations), determine terms and the sequence of accomplishment of ministerial procedures by the Federal Service for Technical and Export Control (further - FSTEC of Russia), and also order of interaction of structural divisions and officials of FSTEC of Russia with the applicants specified in Item 1.2 of Regulations by provision of the state service in implementation (within the competence) non-tariff regulation of foreign trade activity, including issue of licenses for implementation of transactions on export and (or) commodity import (works, services), information, results of intellectual activities (the rights to them) in cases, stipulated by the legislation the Russian Federation (further - the state service).

1.2. On receipt of the state service and receivers of the state service the Russian legal entities and physical persons performing the external economic transactions with goods, information, works, services, results of intellectual activities (the rights to them) which can be used during creation of weapons of mass destruction, means of its delivery, other types of arms and military equipment or by preparation and (or) making of acts of terrorism and concerning which the legislation of the Russian Federation establishes export control (further - controlled products) can be applicants.

1.3. The applicant has the right to the numerous request for the state service.

1.9. Informing concerning provision of the state service can be performed:

1.10. In oral form the following information is provided:

list of the documents necessary for receipt of the state service;

1.11. Informing concerning provision of the state service in oral form is performed according to the working schedule of Management. Phone conversation shall not continue more than 10 minutes. In case of personal acceptance consultation time, as a rule, shall not exceed 30 minutes.

When informing in oral form the employee of Management at the beginning of the conversation shall be provided, having entered the surname, name, middle name, the replaced position.

The employee of Management shall tell the addressed person the schedule of acceptance by provision of the state service, the exact postal address of FSTEC of Russia (if necessary - journey route), requirements to the written request.

1.12. The written appeal can be sent by the mailing, is delivered by the applicant directly in expedition or to Management, and also can be directed electronically.

1.13. When informing by e-mail the answer to the address on the questions listed in Item 1.10 of Regulations goes in time, not exceeding two working days from the date of receipt of the address.

2.1. The state service in implementation (within the competence) non-tariff regulation of foreign trade activity, including issue of licenses for implementation of transactions on export and (or) commodity import (works, services), information, results of intellectual activities (the rights to them) in cases, stipulated by the legislation the Russian Federation.

2.2. Provision of the state service is performed by FSTEC of Russia (Management of export control of FSTEC of Russia).

2.3. Is result of provision of the state service:

1) issue of the one-time license on implementation of transactions on export or import of the controlled products included in lists (lists) of controlled goods and technologies approved by presidential decrees of the Russian Federation (further - list products);

2) issue of the general license for implementation of transactions on export of certain type of list products with indication of its extreme number and the countries of end use without determination of the specific buyer (receiver).

The general license is granted only to the Russian legal entity who created the intra-corporate program of export control and received in accordance with the established procedure the certificate on the state accreditation.

The decision on issue of the general license is made by the Government of the Russian Federation;

3) issue of permission of Russian Export Control Commission to export from the Russian Federation of goods and technologies in the form of the specifications included in lists (lists) of controlled goods and technologies approved by presidential decrees of the Russian Federation without transfer to the foreign person for the purpose of temporary use in the territory of foreign state with the subsequent return to the Russian Federation (further - permission to temporary export).

The decision on issue of permission to temporary export is made by Russian Export Control Commission. Organizational and technical and information support of activities of Russian Export Control Commission performs FSTEC of Russia;

4) issue of permission of Russian Export Control Commission to implementation of the external economic transactions with products which are not falling under action of lists (lists) of controlled goods and technologies, but which can be used by foreign state or the foreign person for creation of weapons of mass destruction, means of its delivery, other types of arms and military equipment or are acquired for the benefit of persons concerning whom there are data on their participation in terrorist activities received in accordance with the legislation of the Russian Federation (further - the import permit of products falling under comprehensive control).

The decision on issue of the import permit of products falling under comprehensive control is accepted by Russian Export Control Commission;

5) coordination of permission to re-export (transfer to the third party) of list products;

6) refusal in licensing;

7) refusal in issue of permission to temporary export;

8) refusal in issue of the import permit of products falling under comprehensive control;

9) refusal in coordination of permission to re-export (transfer to the third party) of list products.

Term of provision of the state service

2.4. The maximum term of provision of the state service shall not exceed 45 days from the date of receipt in FSTEC of Russia of the written address of the applicant and documents specified in Items 2.8 - 2.12 Regulations, on condition of observance stipulated in Item 2.13 Regulations of requirements.

2.5. In cases, stipulated in Item 2.21 Regulations, provision of the state service it can be suspended before elimination of the reasons which caused suspension of provision of the state service.
