Regulations on content of border control in case of the omission of persons, vehicles, loads, goods and animals through frontier of the Russian Federation

1. This Provision determines content of border control in case of the omission of persons, vehicles, loads, goods and animals through frontier of the Russian Federation (further - frontier).

Border control is understood as the state control which consists in carrying out complex of actions for recognition of legality of crossing of frontier by persons driving to the Russian Federation or in permission to crossing of frontier by persons leaving the Russian Federation and also in implementation of actions for detection and detention of breakers of rules of crossing of frontier, identification of sources of ionizing radiation at check points through frontier with state members of the Customs union, and in the cases established by the legislation of the Russian Federation - on detection and detention of the loads, goods and animals prohibited by the legislation of the Russian Federation to import to the Russian Federation or to export from the Russian Federation.

Border control is exercised taking into account risks assessment of possible violation of the mode of frontier.

2. Border control includes:

a) control of persons for establishment of the bases on the right of departure from the Russian Federation or entry into the Russian Federation;

b) control of vehicles, loads and goods for detection and detention of breakers of rules of crossing of frontier;

c) control of persons, vehicles, loads and goods for identification of sources of ionizing radiation at check points through frontier with state members of the Customs union.

3. During border control it is performed:

a) check of validity of documents at persons following through frontier on the right of entry into the Russian Federation or departure from the Russian Federation;

b) accomplishment of border control of orders of state bodies by divisions concerning persons whose right to departure from the Russian Federation is limited in the procedure established by the legislation of the Russian Federation or entry of which into the Russian Federation or departure from the Russian Federation is controlled by the bodies authorized on that;

c) registration and accounting of actual data of persons, the following through frontier, with use of information systems;

d) identification of sources of ionizing radiation with the subsequent informing in accordance with the established procedure territorial authorities of the interested federal executive bodies;

e) detection and detention in the cases established by the legislation of the Russian Federation, loads, goods and animals who are prohibited to import to the Russian Federation or to export from the Russian Federation.

4. Content, the sequence and duration of control actions when implementing border control is reflected in the technological scheme of border control of persons, vehicles, loads, goods and animals developed in the boundary body according to the procedure determined by regulations of federal executive body in the field of safety.
