Methodical instructions for accounting and determination of the damage caused by illegal fellings in the territory of forest fund

1. General provisions

1. These Methodical instructions for accounting and determination of the damage caused by illegal fellings in the territory of forest fund (further - Methodical instructions) are developed according to the subitem 17) of Item 1 of Article 13 of the Forest code of the Republic of Kazakhstan.

2. Illegal felling of the wood - the cabin of the trees and bushes in forest fund of the Republic of Kazakhstan including damaged and the dead as a result of natural, anthropogenous and technogenic factors: without logging ticket; under the logging ticket made with abuse of regulations of cabins of the wood on sites of the state forest fund, made with violation of the terms established in the logging ticket; the cabin in the sizes exceeding settlement cutting area.

3. Accounting and determination of the damage caused by illegal fellings in the territory of forest fund is made by forest owners within three calendar days with the subsequent entering of data on damage into the report on audit of forest bypasses, and also the state forest management organizations in case of complex assessment of forest management for last auditing period.

4. The damage from illegal fellings in the territory of forest fund includes:

1) the extent of harm from illegal fellings and damage of trees and bushes to extent of the termination of growth, wood plunder by physical persons and legal entities;

2) the extent of harm from damage of trees and bushes not to extent of the termination of growth;

3) the extent of harm from illegal fellings of trees and bushes, plunder of wood of the slash, windfall, damaged by the fire trees;

4) the extent of harm from the felling of young growth and undergrowth which is not closed forest cultures, destruction or damage of subjects to selection and seed-growing and selektsionnogenetichesky appointment, landing material to forest nurseries, trees and bushes on plantations;

5) the extent of harm from illegal getting, procurement, damage or destruction of the plants included in the Red List of the Republic of Kazakhstan;

6) expenses on reforestation of the sites of forest fund damaged by illegal fellings.

5. Accounting and determination of the damage caused by illegal fellings in the territory of forest fund is performed using the order of the Government of the Republic of Kazakhstan of May 31, 2007 No. 441 "About approval of base rates for calculation of the extent of the harm done by violation of the forest legislation of the Republic of Kazakhstan" (further - Base rates).
