About approval of Rules of state registration of the agreement of long-term forest utilization on sites of the state forest fund in territorial subdivisions

1. Approve the enclosed Rules of state registration of the agreement of long-term forest utilization on sites of the state forest fund in territorial subdivisions.

2. This resolution becomes effective after ten calendar days from the date of the first official publication, except for the subitem 8) of item 4 of Rules of state registration of the agreement of long-term forest utilization on sites of the state forest fund in territorial subdivisions which becomes effective since January 1, 2013.

Rules of state registration of the agreement of long-term forest utilization on sites of the state forest fund in territorial subdivisions

1. General provisions

1. These rules of state registration of the agreement of long-term forest utilization on sites of the state forest fund in territorial subdivisions (dalee-Pravila) are developed according to the Forest code of the Republic of Kazakhstan and establish single procedure for state registration of the agreement of long-term forest utilization on sites of the state forest fund in territorial subdivisions of department of authorized body in the field of forestry (further - territorial subdivisions).

2. The agreement of long-term forest utilization on sites of the state forest fund (further - the agreement) is subject to obligatory state registration.

3. State registration of the agreement is carried out by territorial subdivision on the location of sites of the state forest fund on which long-term forest utilization is performed.

4. Contracts for the following types of long-term forest utilization are subject to registration:

1) wood procurement;

2) procurement of gallipot, wood juice;

3) procurement of minor wood resources (bark, branches, stubs, roots, leaves, kidneys);

4) collateral forest uses (mowing, pasturage of the cattle, maralovodstvo, fur farming, placement of beehives and apiaries, truck farming, melon growing and cultivation of other crops, procurement and collection of herbs and technical raw materials, wild-growing fruits, nuts, mushrooms, berries and other foodstuff, moss, forest laying and fallen leaves, cane);

5) use of sites of the state forest fund for needs of hunting economy;

6) use of sites of the state forest fund for the research purposes;

7) use of sites of the state forest fund for the improving, recreational, historical and cultural, tourist and sports purposes;

8) use of sites of the state forest fund for cultivation of landing material of tree and shrubby species and plantatsionny plantings of special purpose.

2. The documents submitted for state registration of the agreement of long-term forest utilization on sites of the state forest fund

5. For state registration of the agreement the forest user represents to territorial subdivision:

1) the statement for state registration of the agreement according to appendix 1 to these rules;

2) the copy of the protocol of the tender commission on provision of forest resources on sites of the state forest fund in long-term forest utilization;

3) the agreement in 3 copies.

3. Registration of the agreement of long-term forest utilization on sites of the state forest fund

6. The agreement is registered in the magazine in form according to appendix 2 to these rules.

7. Registration is not made in case of representation by the applicant of incomplete document package, the these rules specified in Item 5. The decision on refusal in registration is told the applicant in writing within 2 working days from the date of submission of the statement with indication of causes of failure.

The decision of registering body can be appealed in the procedure established by the legislation.

8. The magazine proshnurovyvatsya, numbered, signed by the responsible person, sealed. Numbering of pages of the magazine is end-to-end. Records by pencil, blots, erasure, correction are not allowed. The log entry according to appendix 3 to these rules is made.

9. In case of agreement cancelation, the forest user within 10 working days provides written information in territorial subdivision.

4. Terms of carrying out state registration

10. Registration of the rights of the applicant is made within 5 working days from the date of submission of documents listed in Item 5 of these rules.

11. Carrying out state registration of the agreement makes sure stamp of registration text which is put down in agreements. Record on the agreement is certified of stamp of registration text by seal and signed by the head of territorial subdivision.

12. In case of change of surname, name, middle name of physical person, by reorganization of the legal entity, forest users within 30 calendar days submit the application for re-registration of the contract with appendix of the relevant documents confirming the specified data.

13. The accepted documents for state registration of the agreement and the magazine are stored in territorial subdivisions.
