About approval of Rules of establishment to insurers of discounts and allowances to insurance rates on compulsory social insurance from labor accidents and occupational diseases

1. Approve the enclosed Rules of establishment to insurers of discounts and allowances to insurance rates on compulsory social insurance from labor accidents and occupational diseases.

2. To the Ministry of Labour and Social Protection of the Russian Federation in coordination with the Ministry of Finance of the Russian Federation and Fund of pension and social insurance of the Russian Federation (further - the insurer):

approve method of calculation of discounts and allowances to insurance rates on compulsory social insurance from labor accidents and occupational diseases;

make explanations on application of the Rules approved by this resolution.

3. Determine that in 2012:

the discount or the allowance is calculated for 2012 proceeding from the main indicators determined following the results of activities of the insurer for 2008 - 2010;

in the presence in 2010 insured event from the death, the event not because of the third parties, to the insurer for 2012 the discount is not established;

values of the main indicators by types of economic activity are calculated and affirm the insurer in coordination with the Ministry of Labour and Social Protection of the Russian Federation no later than June 1, 2012;

the decision on establishment to the insurer of the allowance for 2012 is made by the insurer no later than July 1, 2012;

payment of the allowance in 2012 is performed since the month following after month of establishment of the allowance;

for consideration of question of establishment of discount the insurer no later than July 1, 2012 files to the insurer petition;

the discount is established by the insurer since January 1, 2012.

Rules of establishment to insurers of discounts and allowances to insurance rates on compulsory social insurance from labor accidents and occupational diseases

1. The these rules developed according to the Federal Law "About Compulsory Social Insurance from Labor Accidents and Occupational Diseases" for the purpose of economic interest of insurers in decrease in professional risk regulate questions of establishment to insurers of discounts and allowances to insurance rates on compulsory social insurance from labor accidents and occupational diseases (further - discounts, allowances).

2. Discounts and allowances to insurance rate, the corresponding main type of economic activity of the insurer, are established by Fund of pension and social insurance of the Russian Federation (further - the insurer) for the next financial year within the insurance premiums provided by appropriate section of revenues of the budget of the insurer approved by the Federal Law.

The size of discount or the allowance cannot exceed 40 percent of the established insurance rate.

3. The size of discount and the allowance is calculated the insurer according to the method of calculation of discounts and allowances to insurance rates on compulsory social insurance from labor accidents and occupational diseases approved by the Ministry of Labour and Social Protection of the Russian Federation in coordination with the Ministry of Finance of the Russian Federation and the insurer proceeding from the following main indicators determined following the results of activities of the insurers for 3 years preceding the current year:

a) the providing amount relation on insurance in connection with all insured events which occurred at the insurer to the added amount of insurance premiums;

b) quantity of insured events at the insurer on 1 thousand working;

c) the number of days of temporary disability at the insurer on 1 accident recognized insurance excepting cases from the death.

4. In the presence in prior financial year of insured event from the death, the event not because of the third parties, to the insurer for the next financial year the discount is not established.

5. Discounts and allowances are determined taking into account labor protection condition based on data on results of carrying out special assessment of working conditions and data on the performed obligatory preliminary and periodic medical examinations as of January 1 of the current calendar year.

Data on results of carrying out special assessment of working conditions and the performed obligatory preliminary and periodic medical examinations are reflected the insurer in the reporting under compulsory social insurance from labor accidents and occupational diseases represented to the insurer in place of registration of the insurer in the form approved by the insurer in coordination with the Ministry of Labour and Social Protection of the Russian Federation.

The discount or the allowance is established by the insurer to the insurer if all indicators specified in Item 3 of these rules there is less (discount) or more (allowance) of similar indicators by the form economic activity to which the core activity of the insurer is carried. At the same time the allowance is also established in case of availability at the insurer in prior financial year of group accident (2 persons and more) from the death, the event not because of the third parties.
