ORDER OF THE MAIN STATE TAX AUTHORITIES OF THE REPUBLIC OF MOLDOVA

About departure and receipt of electronic documents by means of the automated information system of creation and turnover of electronic documents between the State Tax Administration, financial institutions and the State Treasury

1. Since September 1, 2012 the electronic documents confirming opening, change, closing or acceptance on tax accounting of bank accounts / the payment accounts suspension of transactions on bank accounts / payment accounts balance and turnover of money into bank accounts / payment accounts, and other documents which are object of document flow between the State Tax Administration, payment service providers and banks shall go and turn out without fail by means of the automated information system of creation and turnover of electronic documents between the State Tax Administration, banks and payment service providers.

2. Approve the Instruction about departure and receipt of electronic documents by means of the automated information system of creation and turnover of electronic documents between the State Tax Administration, payment service providers and banks, according to appendix.

3. The owner of the automated information system of creation and turnover of electronic documents between the State Tax Administration, payment service providers and banks is the State Tax Administration.

4. GU "The Center of Information Technologies in Finance" as the technical and technological administrator of information system of the State Tax Administration, payment service providers, will provide administration, servicing, development and functioning of the automated information system of creation and turnover of electronic documents between the State Tax Administration, the payment service provider and banks.

5. GU "The Center of Information Technologies in Finance" will provide by bank inquiry their free connection to the automated information system of creation and turnover of electronic documents between the State Tax Administration, banks and payment service providers.

6. Responsibility for accomplishment of this order is conferred on chiefs of division of the State Tax Administration and the administrator of GU "The Center of Information Technologies in Finance".

7. Management of legal support of the Main state tax authorities will provide publication of this order in the Official monitor of the Republic of Moldova.

8. This order becomes effective from the date of publication in the Official monitor of the Republic of Moldova.

The instruction about departure and receipt of electronic documents by means of the automated information system of creation and turnover of electronic documents between the State Tax Administration, banks and payment service providers 

I. General provisions

1. The instruction about departure and receipt of electronic documents by means of the automated information system of creation and turnover of electronic documents between the State Tax Administration and the payment service provider (further - the Instruction) establishes procedure for departure and receipt of electronic documents between the State Tax Administration, banks and payment service providers, and also instructions for use the automated information system of creation and turnover of electronic documents between the State Tax Administration, banks and payment service providers (further - AIS SOED).

1-2. If the physical nonresident person who opened the bank account through AIS SOED, and changing the status of physical person as resident bank informs GNS on closing of the bank account through AIS SOED and on opening of the bank account through AIS SOED - physical resident persons.

1-3. The electronic document on opening, change and closing of bank/payment accounts to persons specified in Item 1-1 of the Instruction automatically will receive the status It "is accepted", and then will pass into the status "Is approved" and the procedure of confirmation from the State Tax Administration will not be required.

1-4. For persons specified in item 1-1 of the Instruction, documents can be created by means of two methods:

creation of documents manually at the level of the interface;

loading of documents by means of the XML file.

2. For the purposes of this Instruction the following terms and concepts are applied:

the administrator of users (financial institution) - the physical person, the employee of financial institution, treasury who is responsible for management and operation of the rights to use the AIS SOED resources by users and authorized persons;

the system administrator (Operator) - the physical person working to nag "The center of information technologies in finance" responsible for management and operation of the AIS SOED resources for their use by users, authorized persons and administrators of treasury;

user name and the password - accounting records (accounts) of users on the basis of which the last get access to AIS SOED;

operator - GU "The Center of Information Technologies in Finance" according to the Order of the Government No. 125 of 6.02.2018, after reorganization of the state companies (SC) "Fintehinform", "Fiscservinform"" and "Vamservinform" (The official monitor of the Republic of Moldova, 9.02. 2018, No. 40-47, Art. 144;

the participant of system - financial institution, payment service providers and the division of the State Tax Administration connected according to the procedure, established by this Instruction, to AIS SOED;

the authorized person - the user, the physical person, the employee of the State Tax Administration, financial institution or treasury given right to sign and/or sendings electronic documents within AIS SOED;

profile (accounting record of the user) - the Section AIS SOED containing general information about the participant and the transferred or received electronic documents;

the user - the physical person, the employee of the State Tax Administration, financial institution or treasury using AIS SOED according to the user's rights which it is allocated;

XML - extensible markup language which is used for creation of the web pages which are displayed in the browser (or the navigator).

Terms and the concepts "electronic document management", "electronic document", "temporary tag", "addressee", "authenticity of the electronic document" correspond to sense of the terms and concepts determined in the Law on the digital signature and the electronic document No. 91 of 29.05.2014.
