About modification and amendments in some resolutions of Council of Ministers of the Republic of Belarus and recognition voided some resolutions of Council of Ministers of the Republic of Belarus and their separate provisions concerning archiving and clerical work

In pursuance of article 36 of the Law of the Republic of Belarus of November 25, 2011 "About archiving and clerical work in the Republic of Belarus" the Council of Ministers of the Republic of Belarus DECIDES:

1. Make changes and additions to the following resolutions of Council of Ministers of the Republic of Belarus:

1.1. in Item 2 of the resolution of Council of Ministers of the Republic of Belarus of August 25, 1999 No. 1322 "About approval of the Agreement on the principles and forms of interaction of the State Parties of the CIS in the field of use of archive information" (The national register of legal acts of the Republic of Belarus, 1999, No. 68, 5/1530) of the word "State Committee on Archives and Clerical Work" shall be replaced with words "Ministry of Justice";

1.2. in the resolution of Council of Ministers of the Republic of Belarus of December 1, 1999 No. 1869 "About approval of the Regulations on procedure for rendering the Public archive agency of the Republic of Belarus of paid services by organizations to legal entities and physical persons in use of archive documents and accomplishment to legal entities of paid works on ensuring safety of documents" (The national register of legal acts of the Republic of Belarus, 1999, No. 95, 5/2151; 2003, No. 112, 5/13106; 2006, No. 35, 5/20106):

in the name and the text of the resolution of the word "organizations of the Public archive agency of the Republic of Belarus" shall be replaced with words "the public archive institutions";

in word preamble "with the Law of the Republic of Belarus "About modification and amendments in the Law of the Republic of Belarus "About National Archive Fund and archives in the Republic of Belarus" shall be replaced with words "with article 6 of the Law of the Republic of Belarus of November 25, 2011 "About archiving and clerical work in the Republic of Belarus";

in Regulations on the procedure for rendering the Public archive agency of the Republic of Belarus of paid services by organizations to legal entities and physical persons in use of archive documents and accomplishment to legal entities of paid works on ensuring safety of documents approved by this resolution:

in the name of the word "organizations of the Public archive agency of the Republic of Belarus" shall be replaced with words "the public archive institutions";

in Item 1 of the word "Organizations of the Public Archive Agency of the Republic of Belarus (Further — Archive Organizations)" shall be replaced with words "The public archive institutions";

the second Item 2 to state part in the following edition:

"Contractors of paid works and services within this provision are the public archive institutions.";

to add Item 3 after the word "Rendering" with the word "state";

in Item 5:

to state paragraphs of the fifth and sixth in the following edition:

"project development of local regulatory legal acts and methodical documents in the field of archiving and clerical work;

consultation of representatives of state bodies, other organizations, citizens of the Republic of Belarus, including individual entrepreneurs, concerning archiving and clerical work;";

"approves the list of the standard documents of National Archive Fund which are formed in the course of activities of state bodies, other organizations and individual entrepreneurs with indication of terms of their storage;

establishes procedure for creation and approval of lists of sources of completing of the Public Records Offices;

establishes procedure for conducting examination of value of the documents included in structure of National Archive Fund;

establishes procedure for reference of documents of National Archive Fund to category of especially important or unique documents;

sets storage mode, accounting and use of scientific and technical documentation, film, photo, phono - and video documents, documents in electronic form, information resources, and also especially important and unique documents;

establishes procedure for creation and storage of insurance copies of especially important and unique documents;

establishes form of submission of data on types of the accepted documents, including on staff, and terms of their storage by transfer of archive documents by the liquidated organization in archive of its superior organization (archive of the founder (participant);

establishes procedure for the conclusion of agreements on prolongation of terms of temporary document storage of the state part of National Archive Fund;

determines procedure for issue of the security obligations signed by the owner of documents of National Archive Fund for the purpose of ensuring their safety;

establishes procedure for destruction of documents of National Archive Fund of temporary storage;

establishes procedure for use of the archive documents which are stored in the Public Records Offices, territorial (city or district) archives;
