This Law regulates legal, organizational, economic basis of primary professional education, regulates the activities of subjects of industrial practice structures of the Republic of Tajikistan aimed at providing the rights of citizens in case of receipt of profession, preparation, retraining and advanced training of personnel in educational institutions of primary professional education.

Chapter 1. General provisions

Article 1. Basic concepts

In this Law the following basic concepts are used:

- primary professional education - purposeful requirements satisfaction of citizens by training which components can be training, retraining and advanced training of the citizens who do not have primary professional education;

- educational institution of primary professional education - the organization performing educational process, realizing one or several educational programs of primary professional education and providing training and education of pupils;

- engineering and pedagogical workers - the persons having the corresponding education and who are engaged on professional basis in training and education of pupils in educational institutions of primary professional education;

- specialty - the professional level which is seized by the pupil in the course of primary professional education that is confirmed by the document of the state model of primary professional education.

Article 2. Legislation of the Republic of Tajikistan on primary professional education

The legislation of the Republic of Tajikistan on primary professional education is based on the Constitution of the Republic of Tajikistan and consists of this Law, other regulatory legal acts of the Republic of Tajikistan and international legal acts recognized by the Republic of Tajikistan.

Article 3. The directions of state policy in the field of primary professional education

The Republic of Tajikistan proclaims area of primary professional education priority.

The directions of state policy in the field of initial professional educations are:

- humanistic, democratic nature of training and education;

- continuity and succession;

- availability of primary professional education, adaptivity of system of primary professional education to levels, features and training of students;

- secular nature of system of primary professional education;

- democratic state public nature of management in system of primary professional education;

- promotion of education and talent.

In educational institutions of system of primary professional education, in governing bodies of primary professional education creation and activities of organizational structures of political parties and religious organizations is not allowed.

Article 4. The state guarantees in the field of primary professional education

For the purpose of implementation of state policy in the field of primary professional education and professional training, the state guarantees the right of receipt of primary professional education by the citizens who got the main general education or general secondary education.

Receipt of free professional education in state educational institutions according to the requirement of the state educational standard of primary professional education is guaranteed to citizens of the Republic of Tajikistan if the citizen gets education of this level for the first time. Orphan pupils can receive the second profession of primary professional education free of charge. The liberty of choice of educational institution, and also form of receipt of primary professional education is guaranteed to citizens of the Republic of Tajikistan.

Article 5. Charter of educational institution of primary professional education

The charter of educational institution of primary professional education is accepted by general meeting of engineering and pedagogical employees of educational institution and affirms the founder.

In the charter of educational institution are without fail specified: name, location (legal, actual address), status of educational institution, founder, form of business of educational institution, purpose of educational process, types and types of implementable educational programs, structure of financial and economic activity of educational institution, procedure for management of educational institution.

The charter of educational institution of primary professional education in the part which is not settled by the legislation of the Republic of Tajikistan is drafted by it independently and affirms his founder.

In need of regulation, aspects of activity of educational institution specified in this Article other local acts, the last are subject to registration as amendments to the charter of educational institution.

Local acts of educational institution cannot contradict its charter.

Article 5 (1). Training language

Training language in educational institutions of primary professional education is determined according to the legislation of the Republic of Tajikistan.

Chapter 2. System of primary professional education

Article 6. The system of primary professional education System of primary professional education consists from:

- state standards of primary professional education;

- training programs of primary professional education;

- educational institutions of primary professional education, irrespective of legal forms and patterns of ownership;

- governing bodies of primary professional education, the companies, organizations and the organizations subordinated to them (educational-experimental farms);

- pupils, their parents, teachers and other employees of educational institutions of primary professional education.

Article 7. Structure of system of primary professional education

In the Republic of Tajikistan the following educational institutions of primary professional education are formed:

- professionally - technical lyceums;

- professional lyceums;

- special professional lyceums;

- industrial practice plants;

- centers of training of adult state bodies of employment of the population;

- social and entrepreneurial training centers;

- training centers under the companies, organizations and the organizations.

Article 8. State standards of primary professional education

Primary professional education is performed within the single state educational standards of primary professional education approved by the Government of the Republic of Tajikistan.

State standards of primary professional education include:

- general requirements to the main educational programs of primary professional education;
