1. Approve the enclosed mode of use of water objects and sources of drinking water supply.

2. To department of strategy of use of natural resources of the Ministry of Agriculture of the Republic of Kazakhstan (Meyrembekov K. A.) in the procedure established by the legislation to provide state registration of this order in the Ministry of Justice of the Republic of Kazakhstan.

3. To impose control of execution of this order on the vice-Minister of Agriculture of the Republic of Kazakhstan Tolibayev M. E.

4. This order becomes effective since October 13, 2011 and is subject to official publication.

Mode of use of water objects and sources of drinking water supply

1. This Mode of use of water objects and sources of drinking water supply (further - use Mode) is developed according to the subitem 13) of Item 1 of article 37 of the Water code of the Republic of Kazakhstan.

2. The mode of use affirms for the purpose of regulation of change in time of amounts of water intake, and also levels and expenses of water objects and sources of drinking water supply, performed for ensuring with water needs of industries of economy and the environment.

3. The mode of use is set taking into account amounts of the water resources specified in permission to special water use.

4. The water user within fifteen calendar days after receipt of permission to special water use for regulation of drain represents to the relevant basin inspectorate for regulation of use and protection of water resources of Committee on water resources of the Ministry of ecology, geology and natural resources of the Republic of Kazakhstan (further – Basin inspection) on approval the Mode of use of water storage basin, in form according to appendix to this Mode of use.

5. The basin inspectorate within fifteen calendar days considers the provided use Mode, and submits for approval in Committee on water resources of the Ministry of ecology, geology and natural resources of the Republic of Kazakhstan (further – Committee).

Based on official data in the field of environmental protection for the corresponding year the Basin inspectorate makes corrections on the provided use Mode.

6. The committee within five working days approves the provided use Mode for term equal to effective period of permission to special water use.

7. After approval of the Mode of use, the Committee within three working days sends the copy of the approved use Mode to Basin inspection.

8. Basin inspection within two working days sends the copy of the approved use Mode to the water user in writing.

9. The mode of use is subject to adjustment by water users in the following cases:

before cold season till November 1;

before warm season till April 1;

changes of ecological and sanitary and epidemiologic condition of water objects and sources of drinking water supply;

changes, the number of the water users and land users who are in zone of influence of water object, and also conditions of their water use.

10. Approval and approval of the modified Mode of use is performed according to Items 4-8 of this Mode of use.

11. In cases of emergency situation of natural and technogenic nature the water user takes measures for operational regulation of the Mode of use with the subsequent written notice of Basin inspection within one calendar day.
