The instruction about the organization of control and public prosecutor's supervision of application of the legislation in the sphere of the state legal statistics and special accounting

1. General provisions

1. This Instruction is developed according to the Law of the Republic of Kazakhstan of December 21, 1995 "About Prosecutor's office" (further - the Law on Prosecutor's office), the Law of the Republic of Kazakhstan of December 22, 2003 "About the state legal statistics and special accounting" (further - the Law on state legal statistics and special accounting), the Law of the Republic of Kazakhstan of January 6, 2011 "About the state control and supervision in the Republic of Kazakhstan" (further the Law on state control and supervision) and other legal acts of the Republic of Kazakhstan and disaggregates control and public prosecutor's supervision of application of the legislation in the sphere of the state legal statistics and special accounting.

2. In this Instruction the following basic concepts are used:

1) control - activities of bodies of legal statistics and special accounting for check and observation of activities of subjects of legal statistics and special accounting (daleesubjekta) regarding compliance of their activities to the requirements established by the legislation of the Republic of Kazakhstan in the sphere of legal statistics and special accounting during implementation and by results of which measures of right restrictive nature without introduction of acts of public prosecutor's supervision can be applied;

2) public prosecutor's supervision - the highest supervision exercised by bodies of legal statistics and special accounting behind exact and uniform application of the laws and regulatory legal acts in the sphere of the state legal statistics and special accounting during implementation and by results of which measures of right restrictive nature with introduction of acts of public prosecutor's supervision can be applied;

3) subjects are the subjects determined by the subitem 13) of article 1 of the Law on state legal statistics and special accounting and the subitem 5) of article 1 of the Law of the Republic of Kazakhstan of January 12, 2007 "About procedure for consideration of appeals of physical persons and legal entities";

4) the authorized prosecutor - the employee who is in the service in staff of body of legal statistics and special accounting to which the class rank and performing the functions of law enforcement agency enshrined in the law is appropriated.

3. For the purpose of law enforcement in the sphere of the state legal statistics and special accounting Committee on legal statistics and special accounting of the Prosecutor General's Office of the Republic of Kazakhstan (further - Committee) and its territorial authorities:

1) exercise public prosecutor's supervision of integrity, objectivity, reliability, sufficiency of data of the state legal statistics and the special accounting provided by subjects without intervention in procedural activities of court and criminal prosecution authorities;

2) is performed by complex of the control and supervising measures directed to identification, elimination and the prevention of violations of the law of the Republic of Kazakhstan in the field of legal statistics and special accounting according to the Law on Prosecutor's office;

4) coordinate statistical activities of state bodies in case of development and program implementation of the state legal statistics and special accounting.
