1. Approve:

Regulations on assessment of language competence and determination of level of proficiency in state language by foreigners who petition for provision of the right to permanent stay in the Republic of Moldova, according to appendix No. 1; sample of the certificate confirming the average level of the ownership of state language issued to foreigners who petition for provision of the right to permanent stay in the Republic of Moldova, according to appendix No. 2.

2. Assessment of language competence and determination of level of proficiency in state language by foreigners who petition for provision of the right to permanent stay in the Republic of Moldova, to assign to the examination committee by determination of level of knowledge of provisions of the Constitution of the Republic of Moldova and state language approved by the Order of the Government No. 1279 of November 19, 2001. "About approval of the Regulations on procedure for determination of level of knowledge of provisions of the Constitution of the Republic of Moldova and state language" (The official monitor of the Republic of Moldova, 2001, No. 141-143, of the Art. 1327), with subsequent changes and amendments.

3. Provide to the Ministry of Public Education the organization of assessment of language competence and determination of level of proficiency in state language by foreigners who petition for provision of the right to permanent stay in the Republic of Moldova, according to the Provision approved by this Resolution.

Chapter I GENERAL PROVISIONS of ASSESSMENT of LANGUAGE COMPETENCE

1. This Provision establishes rules of assessment of language competence and determination of level of proficiency in state language by foreigners who petition for provision of the right to permanent stay in the Republic of Moldova, and also regulates procedure for the organization and carrying out examination testing.

2. The purpose of activities for assessment of language competence of the foreigner consists in determination of level of proficiency in it in state language.

3. Levels of proficiency in state language in foreigners are divided into two categories: unsatisfactory level of proficiency in state language - the foreigner cannot show basic knowledge and the simplest skills of communication, the letter, understanding of state language, and also receives to 50 points from 100 on examination testing, according to provisions of Item 7 of this provision;

the average level of ownership of state language - the foreigner shows language competence of the independent user state language that allows to be integrated effectively into society, it is easy to communicate in social context and to have high degree of awareness on functioning of language, and also gets at least 50 points from 100 on examination testing, according to provisions of Item 7 of this provision.

Chapter II EXAMINATION TESTING AND DETERMINATION of the OWNERSHIP of the STATE LANGUAGE LEVEL

4. The level of proficiency in state language in foreigners certifies skills of understanding of oral speech, written instruments and texts, oral and written expression and is established by examination committee by determination of level of knowledge of provisions of the Constitution of the Republic of Moldova and state language (further - the commission) by results of assessment.

5. Examination in assessment of language competence and determination of level of proficiency in state language by foreigners who petition for provision of the right to permanent stay in the Republic of Moldova is obligatory.

6. And to determination of level of proficiency in state language foreigners pay the state fee for registration for examination in assessment of language competence.

7. Examination in assessment consists of four stages: test for understanding of oral speech, test for understanding of written instruments and texts, written task (essay) and oral test (interview). Overall assessment for four testing constitutes 100 points. For confirmation of the average level of ownership of state language the foreigner shall get at least 50 points from 100, the minimum point for each test - 5 points from 25 (the maximum point on testing).

8. The test for understanding of oral discourse will be organized in the form of the written test on the basis of oral statement, audio-or videos. Duration ispytaniya45 minutes.

9. Testing for understanding of written instruments and texts will be organized in the form of written examination, on the basis of the written instrument - the art, social text, the statement from the newspaper, etc. - and takes 45 minutes.

11. Oral testing (interview) is directed to discussion of certain subject and maintenance of interactive discussion with two members of the commission and 15 minutes last.

12. Tests and subjects of examinations in assessment of language competence and to determination of level of proficiency in state language are developed and established by the commission and are public.

13. Examination in assessment of language competence and determination of level of proficiency in state language will be organized by the commission for each foreigner in individual procedure within 15 calendar days from the date of receipt from the foreigner of the registration application. The registration application on examination in assessment of language competence and determination of level of proficiency in state language moves in the Ministry of Public Education.
