About protection of plants
This Law determines legal, economic and organizational basis of activities in the field of protection of plants and agricultural products against wreckers, diseases and weeds.
In this Law the following basic concepts are used:
- protection of plants - complex of actions in the field of rural and forestry on prevention and elimination of the harm done to plants by wreckers, diseases and weeds, the different methods and means based on combination (organizational and economic, agrotechnical, biological, selection and genetic, chemical, etc.).
- harmful organism - type, version or the biotype of plants, animal or pathogenic organisms harmful to plants or vegetable products;
- especially dangerous harmful organisms - wreckers and the causative agents of diseases of plants capable to periodic mass reproduction, distribution and causing economic, ecological damage;
- the state phytosanitary control - the activities directed to observance by physical persons and legal entities of the legislation of the Republic of Tajikistan on protection of plants;
- neutralization of pesticides - the events held for the purpose of utilization burials or destructions of the pesticides prohibited for use or with expired for applications, and also container from under them;
- objects of agricultural purpose - the agricultural holdings, granaries, vegetable storehouses, the special open areas, production and other rooms intended for production, storage and conversion of agricultural products;
- residual amount of pesticides - the most admissible amount of active ingredient and its biologically active metabolites in products of the long use or further conversion in environment objects;
- pesticides - the chemicals used against harmful and especially dangerous harmful organisms and also for preharvesting drying, removal of leaves and regulation of growth of plants;

- authorized body - the state body performing coordination and regulation of activities of physical persons and legal entities in the field of protection of plants and also the state control in the field of protection of plants;
- phytosanitary measures - package of measures, preventing penetration on the territory of the Republic of Tajikistan of harmful and especially dangerous harmful organisms and their distribution;
- phytosanitary standard rates - the set parameters of sizes used for determination of amounts of phytosanitary measures;
- phytosanitary monitoring - system of observations of development and distribution of harmful and especially dangerous harmful organisms, forecasting and establishment of level of their injuriousness.
The legislation of the Republic of Tajikistan on protection of plants is based on the Constitution of the Republic of Tajikistan and consists of this Law, other regulatory legal acts of the Republic of Tajikistan and the international legal acts recognized by Tajikistan.
The main objectives of state policy in the field of protection of plants are:
- providing favorable phytosanitary situation;

- development of programs in the field of protection of plants, creation of the list of especially dangerous harmful organisms and their submission for approval to the Government of the Republic of Tajikistan;
- development and approval of recommendations and methodical instructions for implementation of phytosanitary measures;
- control of observance of storage precautions, transportations and use of pesticides, development and approval of the regulating documents governing the relations in the field of protection of plants;
- the organization of works on neutralization of pesticides in coordination with authorized state bodies in the field of environmental protection and sanitarnoepidemiologichesky supervision;
- the organization and coordination of activities of other state bodies, physical persons and legal entities for carrying out phytosanitary measures concerning harmful and especially dangerous harmful organisms and their monitoring;
- the organization of public procurements of pesticides, works and services in their storage, transportation, distribution and application within the Republic of Tajikistan, and also creation of the state inventory of pesticides;
- the organization and carrying out explanatory work among the population about carrying out phytosanitary measures and protection of plants;
- implementation of cooperation with other state bodies and the international organizations, participation in program implementation, including international, in the field of protection of plants;
- other powers determined by the legislation of the Republic of Tajikistan.
