About introduction of amendments to some orders of the Ministry of Justice concerning realization of powers of the Ministry of Justice in the field of bankruptcy

According to Items 3 and 9 of the Regulations on the Ministry of Justice of Ukraine approved by the Presidential decree of Ukraine of April 06, 2011 No. 395, I ORDER:

1. Approve Changes in some orders of the Ministry of Justice of Ukraine which are attached.

2. To department of notariate, bankruptcy and functioning of the central zaveritelny body (Chizhmar K. I.) provide this order on state registration according to the Presidential decree of Ukraine of October 03, 1992 to No. 493 "About state registration of regulatory legal acts of the ministries and other executive bodies".

3. This order becomes effective from the date of its official publication.

4. To impose control over the implementation of this order on the director of the department of notariate, bankruptcy and functioning of the central zaveritelny body Chizhmar K. I.

Changes in some orders of the Ministry of Justice of Ukraine

1. In the Regulations on system of training of arbitration managers (managers of property, managing directors of sanitation, liquidators) approved by the order of the Ministry of Justice of Ukraine of September 12, 2011 No. 2094/5, registered in the Ministry of Justice of Ukraine on September 14, 2011 for No. 1084/19822:

1.1. In the Section ІІ:

the third and fourth Item 2.1 to state paragraphs in such edition:

"performs preparation or advanced training of specialists in the directions (specialties) or "Right", or "Economy and entrepreneurship", or "Management and administration", or "Public administration";

has the third or fourth level of accreditation in one of the specified directions (specialties) within at least three years or has experiment on carrying out training or advanced training of specialists of highly specialized profiles together with the central executive bodies in these directions (specialties) at least 10 years.";

state Item 2.2 in such edition:

"2.2. Institution which intends to conduct training courses represents to Department of notariate, bankruptcy and functioning of the central zaveritelny body of the Ministry of Justice of Ukraine (further - Department) the written notice to which the copies of the documents confirming compliance to the requirements specified in Item 2.1 of this Section certified in accordance with the established procedure are attached.";

to add Item 2.3 after the words "the list of institutions which conduct training courses" with words "(further - the List of institutions)";

add the Section with new Item 2.4 of such content:

"2.4. If institution does not conduct training courses within year from the moment of its inclusion in the List of institutions, it is excluded from the List of institutions what the Department reports to him the information letter about.".

1.2. In the Section ІІІ:

state Item 3.2 in such edition:

"3.2. Institution which intends to conduct training courses prepares the curriculum of carrying out training courses (further - the Plan) and submits it for approval to Department not later than in 30 days prior to the beginning of training courses.";

add the Section with new Item 3.3 of such content:

"3.3. For specification of planning of carrying out training courses on each preparatory rate the Plan is constituted. For each subject matter which is in the Plan the training program of discipline containing statement of specific content of subject matter, the sequence, organizational forms of its studying is constituted, I will eat around them also teachers who will be involved in carrying out the corresponding discipline. Content of subject matter shall contain all obligatory questions determined in the List.".

in Item 3.5:

In case of cancellation of the license of the arbitration manager during certificate effective period on the bases provided by paragraphs third Item 6.1 of the Section VI of the Procedure for control of observance of Licensed conditions of implementation of economic activity of arbitration managers (managers of the property, managing directors of sanitation, liquidators) approved by the order of the Ministry of Justice of Ukraine of October 14, 2011 No. 3177/5, registered in the Ministry of Justice of Ukraine on October 17, 2011 for No. 1197/19935, or recognitions of the invalid license which is not renewed at the scheduled time effective period of the certificate it is considered shestymdesyaty stopped and for receipt of the new license person shall complete training courses, pass examination and receive the new certificate in the procedure established to these Provisions.";

add the Section with Item 5.7 of such content:

"5.7. In case of violation by starting the requirements provided by this Provision, such institution is excluded from the List of institutions what the Department reports to him the information letter about.".

In appendices to the Regulations on system of training of arbitration managers (managers of property, managing directors of sanitation, liquidators) approved by the order of the Ministry of Justice of Ukraine of September 12, 2011 to No. 2094/5, registered in the Ministry of Justice of Ukraine on September 14, 2011 for No. 1084/19822:

in appendix 1:

ІІ to exclude question 6 of the Section.

With respect thereto to consider questions 7-28 respectively questions 6-27;

in question 15 of the Section VI "Center" shall be replaced with words the word "Public service";

in the Section V ІІІ to state question 2 in such edition:

"2. Objects of state-owned property, privatizeable. Objects of state-owned property, not privatizeable.";
