According to article 5 of the Law of Ukraine "About the basic principles of the state supervision (control) in the field of economic activity" the Cabinet of Ministers of Ukraine decides:

1. Approve criteria by which the risk degree from carrying out economic activity is estimated and frequency of implementation of planned actions of the state supervision (control) in the field of technogenic and fire safety according to appendix is determined.

2. Recognize invalid resolutions of the Cabinet of Ministers of Ukraine according to the list which is attached.

to the Resolution of the Cabinet of Ministers of Ukraine of February 29, 2012 No. 306

Criteria by which the risk degree from implementation of economic activity is estimated and frequency of implementation of planned actions of the state supervision (control) in the field of technogenic and fire safety is determined

1. Criteria by which the risk degree from implementation of economic activity in the field of technogenic and fire safety is estimated are:

1) implementation of such activities on:

potentially dangerous objects, objects of the increased danger, and also on the objects having strategic importance for economy and safety of the state according to the list approved by the resolution of the Cabinet of Ministers of Ukraine of March 4, 2015 No. 83 (The Official Bulletin of Ukraine, 2015, No. 20, the Art. 555);

the objects referred to the corresponding category on fire and explosion and fire risk (it is determined according to NAPB B.03.002-2007 "Regulation of determination of categories of rooms, buildings and outside installations on fire and explosion and fire risk");

2) the number of persons which are on object ("Determination of class of effects (responsibility) and category of complexity of construction objects" is determined according to DSTU-N of B of B.1.2-16:2013);

3) the conditional height of the building (fire protection is determined according to DBN V.1.1.7-2002 ". Fire safety of construction objects");

4) area of the object;

5) category of complexity of construction object ("Determination of class of effects (responsibility) and category of complexity of construction objects" is determined according to DSTU-N of B of B.1.2-16:2013);

6) availability of underground and/or basement stores, rooms, constructions (it is determined according to DBN B.2.2-9:2009 "Buildings and constructions. Public buildings and constructions. Basic provisions");

7) object belonging to monuments of architecture and history;

8) rendering services and performance of works of fire-proof appointment.

2. According to the established criteria subjects of managing treat one of three risk degrees - high, average or insignificant.

3. Subjects concern subjects of managing with high risk:

1) performing activities in the territory and/or in the rooms belonging to them on the property right, ownerships, uses:

objects of the increased danger and objects having strategic importance for economy and safety of the state;

industrial, store buildings (constructions), outside installations which on fire and explosion danger belong to the category "A" or "B";

industrial, store buildings (constructions), outside installations, on fire risk belong to the category "B", the area:

- 500 sq.m and more - for industrial buildings (constructions), outside installations;

- 1000 sq.m and more - for store buildings (constructions);

objects on which stay of 50 and more people having at least one of the following signs is provided:

- Are located on basement and/or underground stores;

- Work at night (with 23 on 7:00);

objects on which stay of 100 or more persons is provided;

objects which are houses and/or constructions with conditional height more than 47 meters;

objects, is monument of architecture and/or history of national value;

2) the IV-V categories of complexity performing activities for construction of facilities;

3) which according to the obtained license have the right to provide services and to perform works of fire-proof appointment to the territories and/or in the rooms belonging to subjects of managing with high risk;

4) being the public, regional, municipal, object rescue service, and also rescue service of public organization.

4. Subjects concern subjects of managing with average risk degree:

1) performing activities in the territory and/or in the rooms belonging to them on the property right, ownerships, uses:

potentially dangerous objects;

industrial, store buildings (constructions), outside installations, on fire risk belong to the category "B", the area:

- From 0 to 500 sq.m - for industrial buildings (constructions), outside installations;

- From 0 to 1000 sq.m - for store buildings (constructions);

the objects located on basement and/or underground stores in rooms, constructions in which stay from five to 50 people is provided;

objects in which stay from 50 to 100 people who do not belong to group with high risk is provided;

objects which are houses and/or constructions with conditional height from 26,5 to 47 meters inclusive;

objects that is monument of architecture and/or history of local value;

2) performing activities:

Construction of facilities of I and II categories of complexity which area exceeds 300 sq.m (including built in buildings), except individual (farmstead) apartment houses, garden, country houses, economic (home) buildings and constructions, individual garages;

on construction of facilities of III category of complexity;

3) which according to the obtained license have the right to provide services and to perform works of fire-proof appointment to the territories and/or in rooms, except those which belong to subjects of managing with high risk.

5. The subjects which are not belonging to subjects of managing with high and average risk degree and also the subjects having certificates on quality management system which conforms to requirements of the regulating documents in the field of fire safety regulating procedure for designing, installation and maintenance of fire protection systems and general requirements of DSTU ISO 9001:2009 "Quality management system concern subjects of managing with insignificant risk degree. Requirements" (ISO 9001-2008, IDT).

6. Planned actions of the state supervision (control) of observance by subjects of managing of the legislation in the field of technogenic and fire safety are performed with such frequency:

with high risk - not more often than once a year;

with average risk degree - not more often than once in three years;
