THE ORDER OF THE NATIONAL AGENCY OF UKRAINE CONCERNING PUBLIC SERVICE

of April 3, 2012 No. 61

About approval of the Procedure for training of government employees

According to article 30 of the Law of Ukraine of November 17, 2011 No. 4050-VI "About public service" PRIKAZYVAYU:

1. Approve the Procedure for training of government employees it (is applied).

2. Provide to legal management submission of this order on state registration in the Ministry of Justice of Ukraine.

3. To provide to management of the organization of training, management of methodical ensuring activities of personnel services of National civil service of Ukraine after state registration in the Ministry of Justice of Ukraine bringing this order to permission of the central executive bodies, other state bodies, Council of Ministers of the Autonomous Republic of Crimea, the regional, Kiev and Sevastopol city public administrations.

4. This order becomes effective at the same time with entry into force of the Law of Ukraine of November 17, 2011 No. 4050-VI "About public service".

5. To impose control over the implementation of this order on the vice-chairman of National civil service of Ukraine according to distribution of obligations.

Procedure for training of government employees

І. General provisions

1.1. For the purpose of increase in level of professional competence of the government employee and acquisition of practical experience its training which is one of forms of increase in level of professional competence, with lead over service from one to six months in other position of public service in the same or other state body, authority of the Autonomous Republic of Crimea or their device can be held by it.

The training of the government employee is performed in case of requirement, but at least once in three years.

1.2. Need of increase in level of professional competence of the government employee is determined by his direct head and service of personnel of state body, authority of the Autonomous Republic of Crimea or their device by results of estimation of office activities.

1.3. The direction of the government employee on training in other state body, authority of the Autonomous Republic of Crimea or their device is performed based on the order of the head of public service of state body.

1.4. The admission on training, terms and changes of the procedure of its passing are drawn up by the order of the head of public service of state body where the training is held.

1.5. The training of the government employee is held with separation from the main work. For the government employee directed to training its position and the salary on principle place of employment remain.

Also expenses on journey to the place of training and back, daily allowance for the time spent on the way and hiring of housing are refunded to person who passes training in other settlement on principle place of employment.

1.6. Content of training is determined by the individual plan (appendix 1) which affirms the head of the structural unit of body in coordination with the head of public service as state body where the training is held.

ІІ. The rights and obligations of person who passes training

2.1. During passing of training rules of the internal office schedule of state body, authority of the Autonomous Republic of Crimea or their device where he passes training which he shall observe extend to the government employee.

Person who passes training:

can take part in activities of body, prepare draft documents, be present at meetings;

shall perform in full and timely the tasks provided by the individual plan of training;

enhance professional knowledge, skills, combining them with practical activities with use of positive experience of the relevant state body;

follow instructions and orders of the head of training, to observe professional ethics and culture of behavior.

2.2. After the end of training person who passed training submits to the head of training the report on results of training.

ІІІ. Rights and obligations of the head of training

3.1. For training the head of training from among heads of structural divisions of this body is fixed in state body for the government employee.

3.2. Head of training:

gives help in enhancement of professional ability and skills;

controls accomplishment of the individual plan;

provides access to the organization of work of public authority in which person passes training;

hears if necessary at the corresponding meetings reports of persons which pass training, on the training course, carries out the individual work directed to their responsible attitude to accomplishment of job responsibilities;

attracts persons who pass training, to activities of structural division;

studies business and moral qualities of person who passes training.

The head of training after representation to government employees of the report on results of training draws up conclusion about results of training (appendix 2) which contains negative, positive or excellent assessment of accomplishment by the government employee of the individual plan of training and its reasons. The specified conclusion moves together with the individual plan to the head of public service in state body where the training was held.

IV. Training results

4.1. By results of training in state body the reference for representation on principle place of employment is issued to the government employee who passed training (appendix 3).

Documents on passing of training and its results are added to the personal record.

4.2. If by results of passing of training the government employee received excellent assessment, he can be transferred according to the decision of the head of public service in state body, authority of the Autonomous Republic of Crimea or their device to higher vacant post of the same public service or the previous group of positions of public service by numerical determination in the same state body, authority of the Autonomous Republic of Crimea or their device according to its written application.

Results of training are considered during estimation of results of office activities of the government employee.
