1. Approve the enclosed Rules of the organization and carrying out background ecological researches when carrying out oil operations in the Kazakhstan sector of the Caspian Sea.
2. This resolution becomes effective after ten calendar days from the date of the first official publication.

1. These rules of the organization and carrying out background ecological researches when carrying out oil operations in the Kazakhstan sector of the Caspian Sea (further - Rules) are developed according to the Ecological code of the Republic of Kazakhstan of January 9, 2007, determine procedure for the organization and carrying out background ecological researches (further - FEI) when carrying out oil operations in the Kazakhstan sector of the Caspian Sea.
Territorial borders of action of Rules extend to all water area (mirror of surface of the water) of the Kazakhstan sector of the Caspian Sea. The action area of Rules joins also estuarial sections of the rivers flowing into the Kazakhstan sector of the Caspian Sea, bay, gulfs and water areas of seaports.
2. In these rules the following basic concepts are used:
1) benthos - set of the organisms, all or most part of life living at the bottom of oceanic and continental reservoirs in its soil and on soil, leading both the mobile, and sedentary (attached) conduct of life;
2) zooplankton - animal forms of plankton;
3) ground deposit - the solid material besieged as a result of allocation from suspension on bottom of water object both mobile, and static;
4) components of the marine environment - atmospheric air, sea waters, ground deposits, sea flora and fauna;
5) the marine environment - the combination of physical, geological, chemical and biological factors of the environment limited to water thickness, bottom and airspace over the water area of the sea;
6) phytoplankton - set of the vegetable organisms inhabiting thickness of water of sea and fresh reservoirs and which are passively transferred by current;
7) saprobity level - the characteristic of degree of impurity of reservoir organic substances, is established on specific structure of the organisms saprobionts living in it;
8) organisms - saprobionts - the water organisms living in the reservoir which is strongly contaminated by organic substances with small content of the oxygen dissolved in water;
9) the FEI station - stationary Item on which with the fixed geographical coordinates are made: observation/measurement/sampling for determination of meteorological, hydrological, chemical, physical and biological characteristics of the environment;
10) background ecological researches of the marine environment - carrying out special researches of initial condition of the marine environment in the territory of the contract area (the project territory) prior to activities of the user of nature.
3. FEI are carried out at stage of preproject and project activities of the user of nature, from the moment of right possession registration (the license or the contract for environmental management) on the oil and gas field prior to oil operations.
4. FEI in the contract (licensed) area in the Kazakhstan sector of the Caspian Sea include simultaneous carrying out researches of initial condition of the marine environment on all licensed block / to the contract area, the specific oil and gas field (structure) and on separate production facilities (sites) taking into account stages of oil operations.
5. The FEI program is developed by the user of nature and approved by authorized body of environmental protection.
6. Are established by the FEI program:
1) the researched components of the marine environment (atmospheric air, sea waters, ground deposits, benthos, phytoplankton, water vegetation, fish fauna, avifauna, seals);
2) the list of observed parameters on each component of the marine environment;
3) frequency and duration of observations;
4) arrangement of stations of observations in space with indication of their coordinates and location on the schematic map;
5) techniques of maintaining all types of observations, normative and technical, methodical and metrological support of FEI;
6) terms of preparation of reports and report types.
7. FEI of the environment are performed in the Kazakhstan sector of the Caspian Sea by the user of nature individually, and also together with other users of nature in coordination with authorized body in the field of environmental protection.
8. FEI is performed by the production or independent laboratories accredited according to the procedure, the established legislation of the Republic of Kazakhstan on technical regulation.
Reporting materials on FEI are represented to the user of nature according to the available contractual commitments.
9. Background ecological researches in the Kazakhstan sector of the Caspian Sea are performed at stations of background ecological researches (further - FEI stations). Schemes of placement of FEI stations:
1) FEI stations of the first level for dot and vulgar objects can be: circular, crosswise, rhomboid. FEI stations are located from dot (vulgar) object at distances: 250 m, 500 m, 1000 m, 1500 m and further to impact border, according to the scheme according to appendix 1 to these rules;
2) the distance between FEI stations of the second level shall not exceed 2-5 km. In case of the sizes of the area of the field (structure) to 20 sq.km, distance between FEI stations no more than 2 km (at least 3 stations on 2 sq.km). In case of the area of the field from 20 to 500 sq.km of the FEI station no more than 5 km one from another are located on regular grid at distance (1 station on 10 sq.km). In case of the area of the field more than 500 sq.km of the FEI station are located on regular grid at distance to 10 km (at least 1 station on 20 sq.km);
3) the arrangement of FEI stations of the second level is performed taking into account arrangement of FEI stations of the third level. At the same time, at least one of points of FEI stations of the third level shall enter grid of points of FEI stations of the second level, according to the scheme according to appendix 2 to these rules;
