About compensation of the means spent for treatment of person which was injured from criminal acts

The parliament of the Republic of Moldova adopts this law.

Art. 1. - Determine that the means spent for hospitalization of person which was injured from intentional criminal acts are subject to collection in the income of the state from person condemned for this crime.

The means spent for hospitalization are not subject to collection in case of damnification in case of excess of limits of justifiable defense or in the heat of passion.

Art. 2. - Money recovery, the victims spent for hospitalization, is made by court in case of adjudgement based on the criminal case file.

If the civil action was not made, the court in case of adjudgement has the right to resolve on own initiative question of collection of the specified means.

If in case of adjudgement the decision on collection of these means was not made, their collection is made according to the procedure of civil legal proceedings.

Art. 3. - Rates and procedure for calculation of the means spent for hospitalization are established by the Government.

Art. 4. - In case of treatment of the victim in private medical institution or costs of additional resources for its treatment in the public medical institution case on collection of these means is considered by court according to the statement of the victim.
