The government of the Russian Federation and the Government of the Republic of Uzbekistan which are hereinafter referred to as by the Parties for the purpose of providing favorable conditions for economic, production and sci-tech cooperation of the companies and organizations of defensive industries of the Parties, agreed as follows:
The parties shall keep on mutually advantageous basis the developed production and scientific and technical cooperation between the companies of defensive industries in the field of development, productions of military products and products of economic appointment, rendering military services, and also cooperation in case of supply activity of materials, semifinished products, components necessary for this purpose, educational and auxiliary property.
The parties agreed that cooperative supply of materials, semifinished products, components, educational and auxiliary property, service of technological and scientific and technical nature is performed according to the legislation of the Parties and on the basis of the contracts signed by business entities of the Parties.
Mutual delivery between the Russian Federation and the Republic of Uzbekistan of the materials, semifinished products, components and other material resources necessary for the arms production and military equipment within the developed cooperative communications, is performed according to the approved lists. The specified lists containing lists of the companies performing deliveries, and also the nomenclature and amounts of products are annually approved by the State committee of the Russian Federation on defensive industries and the State committee on forecasting and statistics of the Cabinet of Ministers of the Republic of Uzbekistan. The procedure for settlement between the companies of the Russian Federation and the Republic of Uzbekistan is determined by the existing intergovernmental agreements and the legislation of the Parties.
Products delivered according to the lists specified in Article 3 of this agreement are not subject to quoting and licensing. The parties exempt the goods provided in lists from customs duties as in the territory of the Russian Federation, and in the territory of the Republic of Uzbekistan.
The parties will hold consultations on rapprochement of the limits of profitability established on goods delivered in cooperation.
The parties will share the operating and again created grounds, the test centers and laboratories. Works will be carried out on concluded between the companies and the organizations of the Russian Federation and the Republic of Uzbekistan contracts. Results of the carried-out testing are recognized both Parties.
Questions of development and production of new samples of arms and military equipment with participation of the companies and organizations of the Russian Federation and the Republic of Uzbekistan will be determined by free intergovernmental agreements.
The parties will not sell and transfer to the third party, including foreign physical, legal entities or the international organizations, mutually delivered military products, scientific and technical information on it, results of researches, and also to work inventions, "know-how" without preliminary mutual coordination.
The parties charge to military representative offices of the Ministries of Defence of the Russian Federation and the Republic of Uzbekistan to perform at the companies acceptance of delivered goods of military and technical appointment according to the existing technical and regulating documentation.
All matters of argument which can arise between the Russian and Uzbek companies by delivery of products according to this agreement will be permitted on the conditions provided in contracts in foreign trade.
To assign control and coordination of actions for implementation of this agreement: from the Russian Federation - on the State committee of the Russian Federation on defensive industries; from the Republic of Uzbekistan - on the State committee on forecasting and statistics of the Cabinet of Ministers of the Republic of Uzbekistan. This agreement becomes effective from the date of signing. The agreement can be changed or added in the consent of the Parties.
This agreement will be effective within 3 years and will be prolonged automatically for the subsequent year periods if any of the Parties does not make the written application on the desire to terminate this agreement not later than 6 months before the end of the corresponding period.
It is made in Tashkent on January "26", 1994 in duplicate, and both texts are equally authoritative.
