About approval of Rules of development, consideration and selection of the budget investments directed to realization of especially important and requiring operational realization tasks having positive offers of the Republican budget commission

According to Item 8 of Article 151 of the Budget code of the Republic of Kazakhstan of December 4, 2008 the Government of the Republic of Kazakhstan DECIDES:

1. Approve the enclosed Rules of development, consideration and selection of the budget investments directed to realization especially important and requiring operational realization of the tasks having positive offers of the Republican budget commission.

2. This resolution becomes effective since July 1, 2011.

Rules of development, consideration and selection of the budget investments directed to realization of especially important and requiring operational realization tasks having positive offers of the Republican budget commission

1. General provisions

1. These rules of development, consideration and selection of the budget investments directed to realization of especially important and requiring operational realization tasks having positive offers of the Republican budget commission (further - Rules), are developed according to Item 8 of Article 151 of the Budget code of the Republic of Kazakhstan of December 4, 2008 (further - the Budget code).

2. These rules determine procedure for development, consideration and selection of the budget investments directed to realization especially important and requiring operational realization of the tasks having the positive offer of the Republican budget commission (further - budget investments with the condition suspensive).

3. In these rules the following concepts are used:

1) the administrator of the budget programs (further - ABP) - the state body responsible for planning, reasons, realization and achievement of results of the budget programs;

2) the economic conclusion on the investment offer - the conclusion of the central authorized body on state planning regarding economic feasibility of implementation of the investment project containing in the investment offer as the budget investment project, compliance of project objectives to the priorities of development of industry (sphere) of economy established by strategic and (or) program documents;

3) the economic conclusion according to the budget investment project - the conclusion of the central authorized body on state planning regarding economic feasibility of implementation of the budget investment project, its influence on national economy and the compliance to strategic and (or) program documents prepared based on the conclusion of economic examination of the feasibility statement on the budget investment project;

4) the economic conclusion on budget investments by means of participation of the state in the authorized capital of legal entities - the conclusion of the central authorized body on state planning regarding economic feasibility of implementation of budget investments, their influence on national economy and the compliance to strategic and (or) program documents prepared based on the conclusion of economic examination of financial and economic reasons for budget investments by means of participation of the state in the authorized capital of legal entities;

5) the condition suspensive - inclusion in the draft of the republican budget of the budget investments directed to realization of especially important and requiring operational realization tasks having positive offers of the Republican budget commission (further - RBC), with condition of submission of missing documentation by administrators of the budget programs within six months from the date of the positive offer of RBC.

4. Budget investments with the condition suspensive, not the last stages of planning established by Articles 152 and 156 of the Budget code, but having positive offers of RBC can join in the draft of the republican budget.

2. Procedure for development, consideration and selection of the budget investments directed to realization of especially important and requiring operational realization tasks having positive offers of RBC

5. Budget investments with the condition suspensive are performed by means of:

1) implementation of the budget investment projects (further - BIP);

2) participations of the state in the authorized capital of legal entities;

3) joint financing of concessionary projects.

6. For determination of budget investments as especially important and requiring operational realization, investment projects and/or actions shall be directed to prevention of the situations menacing to activity and safety of physical persons and legal entities and also prevention of the situations menacing to social and economic and political stability of the country on the advancing / accelerated social and economic development of the country and to be performed according to orders of the President of the Republic of Kazakhstan and/or the Prime Minister of the Republic of Kazakhstan, program documents.

7. The central authorized body on state planning based on the priority directions of budget investments and forecast indicators of social and economic development for the medium-term period, by results of consideration of information obtained from the central executive and other state bodies makes selection of budget investments with the condition suspensive.
