1. Approve the enclosed Regulations on licensing of activities for development, production, realization and acquisition for the purpose of sale of the special technical means intended for secret receipt of information.

2. Recognize invalid acts of the Government of the Russian Federation according to the list according to appendix.

Regulations on licensing of activities for development, production, realization and acquisition for the purpose of sale of the special technical means intended for secret receipt of information

1. This Provision determines procedure for licensing of activities for development, production, realization and acquisition for the purpose of sale of the special technical means intended for secret receipt of information performed by legal entities and individual entrepreneurs.

2. Licensing of activities for development, production, realization and acquisition for the purpose of sale of the special technical means intended for secret receipt of information (further respectively - special technical means, the licensed activities), is performed by Federal Security Service of the Russian Federation (further - the licensing body).

2(1). Implementation of the licensed activities by foreign legal entities is not allowed.

3. The licensed activities are constituted by the following works and services:

a) development, production, realization and acquisition for the purpose of sale of the special technical means intended for secret receipt and registration of acoustic information;

b) development, production, realization and acquisition for the purpose of sale of the special technical means intended for secret visual observation and documentation;

c) development, production, realization and acquisition for the purpose of sale of the special technical means intended for secret listening of telephone negotiations;

d) development, production, realization and acquisition for the purpose of sale of the special technical means intended for secret interception and registration of information from technical communication channels;

e) development, production, realization and acquisition for the purpose of sale of the special technical means intended for secret control of mailings;

e) development, production, realization and acquisition for the purpose of sale of the special technical means intended for secret research of objects and documents;

g) development, production, realization and acquisition for the purpose of sale of the special technical means intended for secret penetration and inspection of rooms, vehicles and other objects;

h) development, production, realization and acquisition for the purpose of sale of the special technical means intended for secret control of movement of vehicles and other objects;

i) development, production, realization and acquisition for the purpose of sale of the special technical means intended for secret obtaining (change, destruction) information from technical means of its storage, processing and transfer;

j) development, production, realization and acquisition for the purpose of sale of the special technical means intended for secret identification of the personality.

4. The licensed requirements imposed to the license applicant (licensee) are:

a) availability on the property right or on other legal cause of rooms, buildings, constructions and other objects in the place of implementation of the licensed activities, the necessary for accomplishment declared works and services and conforming to the established requirements;

b) availability on the property right or on other legal cause of the technical means, the equipment and technical documentation necessary for accomplishment of the declared works and services and conforming to the established requirements;

c) availability in the state at least 1 worker having the higher education and the corresponding professional training necessary for implementation of the licensed activities, and also length of service in the field of the licensed activities at least 3 years;

d) observance by the licensee of requirements of order of registration and accounting of special technical means and the specifications and technical documentation on their production and use;

e) availability at the licensee of contracts for realization and acquisition for the purpose of sale of the special technical means concluded with the bodies authorized on implementation of investigation and search operations and holding investigation and search operations with use of the specified means;

e) availability at the licensee of specifications on development and production of the special technical means approved in accordance with the established procedure by the bodies authorized on implementation of investigation and search operations and holding investigation and search operations with use of the specified means.

5. Gross violation of licensed requirements is understood as failure to meet requirements, specified in subitems "a", "v" and "g" of item 4 of this provision, entailed the effects established by part 10 of article 19.2 of the Federal law "About Licensing of Separate Types of Activity".

6. For receipt of the license the license applicant represents (directs) the application and documents (the copy of documents) specified in Items 1, 3 and 4 parts 3 of article 13 of the Federal law "About Licensing of Separate Types of Activity" to the licensing body and also:

a) copies of documents of title on rooms, buildings, constructions and other objects in the place of implementation of the licensed activities, the rights to which are not registered in the Unified State Register of Rights on real estate and transactions with it (if such rights are registered in the specified register, - data on these rooms, buildings, constructions and other objects);

b) copies of the documents confirming possession on the property right or on other legal cause by the technical means, the equipment and technical documentation necessary for implementation of the licensed activities;

c) copies of the documents confirming stay in staff of the license applicant of the employees conforming to the requirements provided by the subitem "v" of item 4 of this provision;
