ORDER OF THE GOVERNMENT OF THE KYRGYZ REPUBLIC

About approval of the Regulations on procedure for appointment, payment and the size of temporary disability benefit, maternity allowance and Regulations on procedure for appointment, payment and the size of ritual benefit (on burial)

For the purpose of social improvement of citizens in cases of temporary disability, pregnancy and childbirth, and also the Government of the Kyrgyz Republic decides compensations of funeral services:

1. Approve enclosed:

- Regulations on procedure for appointment, payment and size of temporary disability benefit, maternity allowance;

- Regulations on procedure for appointment, payment and the size of ritual benefit (on burial);

- report form of legal entities about expenses on allowance payment on pregnancy and childbirth and on burial from the republican budget and the Procedure for its filling;

- report form of the individual entrepreneurs working at basis of the patent or tax contract about expenses on allowance payment on pregnancy and childbirth and on burial from the republican budget and the Procedure for its filling;

- report form of peasant farms without formation of legal entity about expenses on allowance payment on pregnancy and childbirth and on burial from the republican budget and the Procedure for its filling;

- form of the summary report of legal entities, the individual entrepreneurs working at basis of the patent or tax contract, peasant farms without formation of legal entity and persons staying on the registry in employment service about expenses on allowance payment on pregnancy and childbirth and on burial from the republican budget and the Procedure for its filling;

- form of calculation of requirement for expense recovery on allowance payment on pregnancy and childbirth and on burial from the republican budget and the Procedure for its filling;

- form of register of expense statements (financing) on allowance payment on pregnancy and childbirth and benefits for burial from the republican budget.

2. Ceased to be valid according to the Order of the Government of the Kyrgyz Republic of 12.04.2016 No. 208

3. Bring in the order of the Government of the Kyrgyz Republic "About measures for the translation of financing of allowance payments for temporary disability, maternity allowances, benefits for burial and improving actions on the government budget" of July 19, 2005 No. 300 the following change:

- in all text of the word "Ministry of Labour and Social Development of the Kyrgyz Republic" in various cases shall be replaced with words "Authorized state body in the sphere of social protection" in the corresponding cases.

4. Recognize invalid:

- the order of the Government of the Kyrgyz Republic "About modification of the order of the Government of the Kyrgyz Republic of August 14, 2006 No. 576 "About appointment and allowance payment on temporary disability, maternity allowances, ritual benefits (on burial)" of July 31, 2008 No. 414.

5. Financing of actions which realization is provided in the above-stated provisions to make within the means provided by the republican budget for the corresponding year.

6. To impose control of execution of this resolution on department of social security, health care, work and migration of Government office of the Kyrgyz Republic.

7. This resolution becomes effective since November 1, 2011.

8. Publish this resolution in official mass media.

Regulations on procedure for appointment, payment and size of temporary disability benefit, maternity allowance

1. General provisions

1. This Provision is developed for the purpose of providing the working citizens with temporary disability benefits, on pregnancy and childbirth and provides procedure for their appointment, payment and the sizes.

This Provision does not extend to the military personnel of system of defense, homeland security, the border service, execution of punishments, emergency situations, the staff of law-enforcement bodies, monitoring bodies of drugs, financial police, customs authorities, except civilian persons of above-mentioned security agencies.

Action of this provision extends to the citizens of the Kyrgyz Republic who are constantly living in the territory of the Kyrgyz Republic and the foreign citizens of the member countries of the Agreement on the Eurasian Economic Union of May 29, 2014 working and living in the territory of the Kyrgyz Republic.

2. In this Provision the following terms and determinations are used:

benefit - the payment made in case of approach of cases of temporary disability, pregnancy and childbirth in the amount of and on the conditions established by the legislation;

disability leaf - the document certifying temporary disability of citizens in case of diseases, injuries and pregnancy and childbirth;

coefficient of surcharges to the salary (or district coefficient to the salary) - the state guarantee and compensation for the persons living and working in the mountain and remote remote zones established by the legislation;

general working life - the total duration of labor and other socially useful activity, irrespective of the being available breaks;

acute occupational disease - the disease which arose after single (during no more than one working shift) impacts of harmful production factors.

3. Temporary disability benefit and maternity allowance is paid:

- to the faces consisting in employment relationships with the employer;

- to individual entrepreneurs;

- to members of peasant farms (further - peasant farm).

4. The right to benefits comes for:

- workers - from the date of emergence of employment relationships also stops in day of the termination of the employment contract;

- individual entrepreneurs - since month of the tax discharge, acquisition of the patent or the conclusion of the tax contract also stops upon termination of the term of their action;

- members of peasant farm - since establishment of the right of private property to the parcel of land.

5. The maternity allowance is paid to the citizens having the official status of the unemployed, staying on the registry in authorized state body of employment (further - employment service).

6. Temporary disability benefit and maternity allowance are not paid to unemployed persons who do not stay on the registry in employment service.

7. The allowance is granted if the request for it followed no later than six months from the date of recovery of working capacity, establishment of disability, the end of maternity leave.

Limitation period of payment of these benefits is established according to the terms provided by the Civil code of the Kyrgyz Republic.

8. Own means (the income or the salary fund) of the employer, the individual entrepreneur, peasant farm (further - the employer) are allowance payment source:

- on temporary disability for all working days;

- on pregnancy and childbirth for the first ten working days (from eleventh working day the benefit is paid from means of the republican budget).

At the same time the maternity allowance for all working days is completely paid to the worker by the employer, and the amount of the benefit paid from eleventh working day is compensated to the employer from means of the republican budget after submission of the report to district and city managements of social development of the population of authorized state body in the sphere of social development (further - management of social development).

The employer has the right to pay maternity allowance in complete size at the expense of own means, without submitting the report in management of social development for compensation from the republican budget of the amount of benefit from eleventh working day.

9. For the citizens working and living in the mountain and remote remote zones where surcharge coefficients to the salary are established, the size of benefits is determined using these coefficients.
