LAW OF TURKMENISTAN

About especially protected natural territories

(as amended on 03-06-2017)

This Law governs the relations in the field of the organization of management, protection and use of especially protected natural territories representing special nature protection, scientific, cultural, esthetic, recreational and improving value.

Chapter I. General provisions

Article 1. The basic concepts used in this Law

In this Law the following basic concepts are used:

especially protected natural territories - sites of the surrounding environment (lands, the woods, waters, subsoil, airspace), natural complexes and separate objects having special nature protection, scientific, cultural and cognitive, recreational and improving, esthetic value, taken under special protection of the state for the purpose of preserving and recovery of ecological equilibrium, wealth and variety of natural resources and useful properties of the environment;

system of especially protected natural territories - the set of especially protected natural territories of different categories which are ecologically connected among themselves providing representation in them natural complexes and objects of geographical zones;

biological diversity - set of the vegetable, animal and other organisms characteristic of certain territory;

the conservation zone - the zone created around some types of especially protected natural territories for the purpose of their protection against adverse effect with prohibition or restriction within these zones of any activities which are negatively influencing condition and recovery of ecological systems of especially protected natural territories and natural complexes and objects which are on them;

nature protection public institutions - types of especially protected natural territories with the status of the legal entity;

natural complexes of especially protected natural territories - set of objects of live and inanimate nature, subjects to special protection;

The chronicle of the nature - the code of data of the system observations performed by scientific divisions of the national natural parks, national biospheric parks and national natural parks behind condition of the ecological systems and natural objects which are carried out by single technique;

introduction - deliberate or accidental transfer of new types of plants and animals out of circle limits of their dwelling;

the state inventory of especially protected natural territories - the code of data on legal status, geographical location, quantity and quality characteristics of ecological, scientific, economic, educational, cultural and other value of especially protected natural territories;

steady use of especially protected natural territories - use of biological resources of especially protected natural territories thus and such rates which in the long term are not capable to lead to their depletion;

ecological network - complex of especially protected natural territories of the different categories and types connected among themselves and with other types of especially protected natural territories ecological corridors and organized taking into account natural, historical and cultural and social and economic features of the region;

ecological corridor - the part of ecological network provided by the protected sites of lands and water objects connecting especially protected natural territories among themselves and to other types of especially protected natural territories for ensuring natural migration (distribution) of objects of wildlife and their preserving;

protection of especially protected natural territories - complex of the events held in especially protected natural territory for identification and suppression of violations of the law of Turkmenistan;

genetic fund - all set of types of live organisms with their heritable inclinations;

genetic resources - any genetic material of plant and animal origin which is of value for these and future generations of mankind.

Article 2. The legislation of Turkmenistan on especially protected natural territories

1. The legislation of Turkmenistan on especially protected natural territories is based on the Constitution of Turkmenistan and consists of this Law and other regulatory legal acts of Turkmenistan.

2. The relations on use and protection of subsoil, lands, waters, atmospheric air, the woods, plant and animal life and other natural resources of especially protected natural territories in the part which is not settled by this Law are regulated by special laws of Turkmenistan.

3. If the international treaty of Turkmenistan establishes other rules than containing in this Law, then rules of the international treaty are applied.

Article 3. The basic principles of state policy in the field of especially protected natural territories

The basic principles of state policy in the field of especially protected natural territories are:

1) development of the system of especially protected natural territories providing preserving and recovery of biological diversity, ecological systems, unique and typical landscapes;

2) state regulation and control in the field of especially protected natural territories;

3) steady use of especially protected natural territories for the purpose of development of science, culture, education, ecological tourism and harvesting of natural resources;

4) the paid nature of use of especially protected natural territories;

5) compensation of damage caused to especially protected natural territories;

6) responsibility for violation of the legislation of Turkmenistan in the field of especially protected natural territories;

7) participation of citizens and public associations in the solution of tasks of protection and use of especially protected natural territories;

8) information access about especially protected natural territories;

9) international cooperation in the field of especially protected natural territories.

Article 4. The earth of especially protected natural territories

1. The earth of especially protected natural territories treat lands of nature protection, improving, recreational and historical and cultural appointment and are provided according to the procedure, established by the land legislation of Turkmenistan.

2. The earth of especially protected natural territories are exclusive property of the state.

3. On lands of especially protected natural territories the activities contradicting their purpose are forbidden.

Article 5. Categories and types of especially protected natural territories

1. Especially protected natural territories depending on the importance and the value of natural complexes and objects are subdivided into the following categories:

1) especially protected natural territories of the international value having outstanding universal value from the point of view of ecology, the sciences, cultures, esthetics, recreations included and assumed for inclusion in the List of the world heritage of UNESCO, in the list of Worldwide network of biospheric reserves of UNESCO, in the International lists of International union of conservation;
